경계점 및 경계점표지 등록제도 개선 연구

국문 초록

우리나라 지적도는 토지소유와 세금부과를 목적으로 작성되었으며 소유자간의 경계확인을 위한 공부로는 한계가 있었다. 한편, 유럽의 많은 나라에서는 경계확인을 위한 문서로서 지적도가 아니라 Field Note/Field Sketch가 작성되어 사용되었다. 1974년부터 도입된 수치지적부는 현재 경계점좌표등록부로 명칭이 바뀌었는데 지적도보다 정확성에서 장점을 가졌지만 지상경계점에 대한 기록이 자세하지 않았는데, 지상경계점에 대한 더욱 자세한 공부로서 지상경계점등록부, 경계점표지등록부가 최근 작성되고 있다. 본 연구에서는 현재까지의 우리나라 경계 및 경계점표지 등록제도를 고찰하고 지상경계와 공부상경계간의 불일치를 극소화시키며 활용성을 높이기 위한 개선 방향을 제시하고자 하였다. 여기서 제안된 사항은 다음과 같다. 첫째, 지상경계점등록부 및 경계점표지등록부가 작성된 후에는 이것이 경계확인의 기준 공부로서 역할을 해야 한다. 둘째 영구경계점표지의 설치도 함께 이루어져야 한다. 셋째 이들 공부상에 축척계수와 지적기준점에 관련된 상세한 기록을 할 필요가 있다. 넷째 이들 공부에 경계점표지위치도를 작성하여 첨부할 필요성을 설명하고 제안하였다. 다섯째 토지거래에서 지상경계점등록부의 역할에 대해 논하였다. 그리고 마지막으로 전 국토에 대한 영구경계점표지설치 및 지상경계점등록부 작성사업을 제안하였다.

영문 초록

The cadastral map of Korea was made for land ownership and tax, but has limitation as the official book for boundary identifcation between owner. But in many European countries they recorded and used not cadastral map but Field Notes/Field Sketch as the official document for boundary identification. The numeric cadastral Book, which was adapted from 1974 and is named as the boundary coordinate registration book, has more advantage than the cadastral map in accuracy, but it dosen't has detail imformation on boundary point. But recently ground boundary registration book and boundary monument registration book is recorded as a more detailed official book on boundary point, and is used. This study proposes the improvement for successful settlement and operation of these system. And the proposed improvement here is that : First, these books shall be the role as the fundamental registration book for boundary identification. Second, permanent boundary monument marking shall be made with them. Third, scale factors and detail records of GCP are necessary. Fourth, he boundary monuments location sketch is proposed and the necessity is described. Fifth, the role of ground boundary registration book in buy and selling land was discussed. Finally the project of permanent boundary monument marking and ground boundary registration book making for whole territory is proposed.
