국문 초록

관련 법제 미비 및 정책부재로 날로 심화되고 있는 지방자치단체간의 해상관할권 분쟁의 사례를 간단히 살펴보고, 지방자치단체간의 해상경계획정 분쟁을 합리적으로 해결하기 위해서 해양이 중앙정부의 전속적 관할에 속하는지 혹은 지방자치단체에 속하는지 여부와 해상경계의 인정여부 등에 관하여 명확한 입장을 정리 검토 한다. 또한 해양등록부 구축을 위한 첫걸음의 일환으로 국제법규의 적용 및 지적제도를 활용한 해상경계설정 방안에 관하여 연구하기로 한다.

영문 초록

Briefly introduce the case of maritime jurisdiction disputes between local governments becoming more and more serious in the absence of relevant legislation and policy. And In order to solve reasonably maritime delimitation dispute of local governments between, We examine the presence or absence of recognition of the maritime boundary and whether it belongs to the local government, or belongs to the exclusive jurisdiction of the central government of the ocean. In addition, it is that as part of the first step to make a marine public records, to study how to set the maritime boundary utilizing the system and pointed out that the application of law of the sea.
