국문 초록

현행 부동산 법제에서 법정지상권을 둘러싼 논란은 근본적으로 토지와 건물을 별개의 부동산으로 취급하고 각각에 대한 물권변동을 인정하고 있기 때문이다. 본 연구는 토지와 건물의 이원적 체계 보완을 중심으로 저당물의 경매로 인한 법정지상권(민법 제366조)의 문제점과 그 개선방안을 제시한다. 첫째, 법정지상권의 대상인 건물의 불명확성을 극복하기 위해 보호할 가치가 있는 건물에 한정하여 그 성립을 인정하여야 한다. 둘째, 법정지상권 성립요건의 불명확성을 개선하기 위해 법정지상권의 공시기능을 강화하여야 한다. 셋째, 토지소유자 또는 저당권 등의 가치권과 건물의 이용권과의 조화를 위해 토지와 건물의 일괄처분제도가 필요하다. 넷째, 우리 부동산 법제가 유지해 온 토지와 건물의 이원적 체계를 계속 유지하는 것이 반드시 필요한지에 대한 입법 정책적 판단을 요한다.

영문 초록

In the current regulation of real estate, the argument for legal superficies is treated as the individual real estate of land and building fundamentally and real right fluctuations for each are recognized. This study suggests the improvements of problem of legal superficies right (Article 366 of civil law) by mortgage auction, focusing on the dualistic system supplementation of land and building. The first, for overcoming the uncertainty of building concept of legal superficies, the achievement of legal superficies must be recognized by limiting in the buildings which have the value of protection. The second, for improving the uncertainty of achievement condition of legal superficies, the announcing function of legal superficies right must be strengthened. The third, for harmonizing value right of land owning right mortgage, etc. and building using right, blanket disposal system of land and building is necessary. The forth, legislation political alternatives are necessary for the fact if the dualistic system of land and building, that the existing legislation of our real estate has been continued, must be maintained continuously.
