학교폭력에 대한 경찰의 대응

국문 초록

2011년 연말 이후 여러 차례 학교폭력의 피해자가 자살한 것을 계기로 학교폭력에 대한 국가적 관심이 증가하고 있는 실정이다. 하지만, 그간 수년에 걸쳐 학교폭력의 심각성과 대응방안에 대한 논의가 있었음에도 불구하고, 그 빈도나 정도가 갈수록 증가하고 있는 것으로 보인다. 한국과 마찬가지로 미국에서도 학교폭력의 심각성을 이전부터 인식하여 여러 가지 대응책들을 고안하였고, 그것들은 물리적 대응, 상호교류적 대응, 그리고 법률적 대응으로 분류할 수 있을 것이다. 본 연구는 세 가지 중에서 상호교류적 대응과 법률적 대응과 관련한 구체적인 프로그램들을 소개하고, 각각의 프로그램들이 학교폭력에 어느 정도 영향이 있는지 선행연구의 검토를 통해서 알아본 후, 한국의 실정에 반영할 수 있는 부분을 모색하고자 한다. 프로그램 소개에 앞서 미국 내에서의 학교폭력의 정의 및 간략한 역사적 사건들, 그리고, 현재 학교폭력의 실태를 제시하였다. 학교폭력에 대한 상호교류적 대응으로 Drug Abuse Resistance Education(D.A.R.E.) 프로그램과 Gang Resistance Education and Training(G.R.E.A.T.) 프로그램을 중점적으로 살펴보았다. 또한 법률적 대응으로 입법을 통한 대응, 무관용 정책, 학교전담 경찰관제도, 학교경찰제도 등을 소개하였다. 연구의 결과, 학교폭력에 대한 형사사법제도의 다양한 대응책 중에서 상호교류적 대응이 가장 효과적인 것으로 나타났다. 또한 법률적 대응 중에서 학교전담 경찰관제도가 학생과 교사들이 학교를 안전한 환경으로 인식하는 데 도움을 주는 것으로 밝혀졌다. 한국 경찰이 시행하고 있는 프로그램들과 연관하여 몇 가지의 시사점을 논의와 결어에서 제시하였다.

영문 초록

Since December 2011, there have been a number of suicide committed by the victims of school violence in Korea, and this led to the increased attention on school violence around the country. In spite of continuous efforts to decrease school violence, the frequency and severity of school violence have increased during the past years. This is also the case in the U.S., and the police makers suggested a number of methods for school violence in the U.S.: Physical, interactionist, and legal methods. The purpose of this study is to introduce programs related to interactionist and legal approaches, to review the literature about the effectiveness of the programs on decreasing school violence, and to imply policies that can be applied to the situation of Korea. The definition of school violence, historical events, and the current statistics in the U.S. will be followed by the introduction of Drug Abuse Resistance Education(D.A.R.E.) and Gang Resistance Education and Training(G.R.E.A.T.) as interactionist approach. In addition, legal responses include legislation, zero-tolerance policy, school resource officer, and school police. The results indicated that interactionist approach was perceived most effective among other programs. Also, the school resource officers were considered effective in letting students and teachers feel their school safe. Policy implications were discussed regarding programs conducted by the Korean police in the discussion.
