국문 초록

컴퓨터와 인터넷이용의 대중화는 여러 면에서 기존의 법제가 예상하지 못했던 상황을 불러 일으켜 오고 있다. 중요한 의사교환의 수단으로 되고 있던 종이문서의 자리를 급속히 전자문서가 대처해 나가면서 새로운 법률들이 입법화가 되고 있다. 이를 뒷받침하기 위해 정부에서도 전자문서 보급ㆍ확산에 다각도의 노력을 기울이고 있으나, 종이원본 중심의 관행ㆍ규제로 여전히 전자문서의 유통ㆍ확산 장애가 대두되고 있고 법령개선 필요성이 지속적으로 제기되면서, 종이문서의 경우와 동일하게 취급할 수 있는지에 대한 문제가 대두되고 있다. 이러한 인식의 바탕위에서 전자문서의 개념 및 특성을 파악하고 전자문서를 둘러싼 국내ㆍ외의 법제의 동향과 민사소송상 전자문서의 증거력을 살펴보았다. 결론에서는 전자문서에 관한 일반법의 제정 논의, 기존 종이문서에 의해 형성된 여러 가지 원칙들을 전자문서의 특성에 맞게 변경하려는 체계적인 검토 논의, 공인전자서명의 경우 훼손ㆍ변경의 가능성에 대한 법적 대비책 마련과 함께 전자문서의 실질적 증거력에 대한 법관의 자의적 판단을 좀 더 구체화시켜 나갈 수 있는 방법 등에 대해서도 신중한 논의 과정이 필요하다는 내용으로 시사점을 제시해 본다.

영문 초록

The rapid and wide-spread growth in the use of computers and the Internet has caused many a number of cases which could not properly be addressed with the existing legal system. As the traditional centerpiece of communication, the paper documents give way to the emerging electronic documents, new sets of laws are being introduced to address them. To support this shift to electronic documents, the government is also trying various options to facilitate the usage and spreading of the electronic documents. But the existing regulations and practices are still heavily centered on the paper documents, which is hindering the growth of the use and circulation of electronic documents. This led to persisting requests of enhancing the legal system that covers these issues, which also evoked the question whether the electronic documents can truly be treated as being equal to the paper documents. With this as the beginning point of the inquiry, in this study we examined and investigated the concepts and characteristics of the electronic documents, the current trends surrounding electronic documents in Korea and other nations, and finally, the evidential credibilities of theses new type of documents in civil lawsuits. In conclusion, we suggest as the implications of this study that there need to be discussions for revising and improving the existing codes of laws, systematic reviews and discussions to transform various practices and principles that were formed based on the paper documents to fit electronic documents, preparation of legal solutions for the possibilities of damaging or altering the certified electronic signature system, as well as a careful discussion on the development of a means to specify the arbitrary judgment made by the judges of the courts in terms of the evidential credibilities of the electronic documents.
