프랑스 차별금지 법제도에 관한 소고

국문 초록

프랑스 차별청폐청(차별 철폐와 평등 신장을 위한 고등 기구)은 2005년에 설립되고 2011년에 신설기구(권리방어청)에 통폐합된 독립행정정이다. 이 기구는 프랑스 국내법 및 프랑스가 적용받는 모든 국제법 규범에 근거하여 일체의 차별 행위를 철폐하는 것을 임무로 하였다. 이 기구는 차별 피해 사례를 접수하여 조사, 심리하고 조정안 제시 등의 조치를 취한다. 창립 첫 해 1천 4백여 건이던 심리 건수가 매년 약 20%씩 증가하여 2010년에는 1만 2천여 건으로 증가하였고 전체 국민 가운데 차별철폐청의 존재를 아는 사람의 비율이 첫해에 16%에 불과하던 것이 2009년에는 50%로 증가하였다. 이처럼 사회적 영향력이 컸던 차별철폐청에 대해 차별 문제해소에 유용한 기구라고 보는 시각과 달리 일각에서는 비판도 적지 않았다. 특히 법조계와 경영자들로 부터 조직과 권한이 지나치다는 비판이 많다. 이러한 프랑스의 경험에 대해 본 논문에서는 우선 프랑스의 차별과 관련된 법령들을 전체적으로 검토하며, 프랑스 특유의 ‘무명이력서’제도에 관해 살펴본다. 이어 차별철폐청의 조직과 권한에 대해 상세히 분석하며, 특히 논란이 컸던 차별철폐청의 준사법적 권한에 대해 상원보고서와 꽁세이데따 입장을 통해 프랑스내 논의를 가늠해본다. 이어 차별철폐청에 대한 프랑스 내에서의 평가 내지 비판을 통해 우리의 법제개선을 위한 단초를 도출하고, 사회통합을 위한 시사점을 결론으로 담았다.

영문 초록

‘La Haute Autorité de lutte contre les discriminations et pour l'égalité (The High Authority against Discrimination and for Equality)’, also known by it acronym Halde, was an independent administrative authority in France established in 2005 and disbanded in 2011. It was competent to seize "all discrimination, direct or indirect, prohibited by law or by an international commitment which France is a party." Halde was dissolved on May 1, 2011, and transferred its duties to the ‘Défenseur des droits (Defender of Rights)’ in which a specific college is created to continue the fight against discrimination and promoting equality. Since its creation, the number of complaints recorded by the High Authority rose from 1,410 in 2005 to 12,467 in 2010, with an annual rate of increase of nearly 20% over the last three years. More than half of the French were aware of the Halde in 2009, against 16% four years ago. However, there are some who see it as an effective tool and other critics. Its mission of fighting inequality was also at the interface between legal practitioners and business with a lot of discussion of justification and legitimacy of its organization and powers. In this paper, therefore, we will study the legal texts that constitute the entire legal regime against discrimination in France and then analyze the organization and competences of this institution. Through this work, we could draw our inspiration in politics for social solidarity from the experience of France.
