죽산 조봉암의 헌법사상

국문 초록

죽산 조봉암은 일제시대를 거쳐 대한민국의 건국과 건국 후의 정치에 큰 족적을 남긴 정치인이다. 1899년 9월 25일에 경기도 강화군 남쪽의 원면이라는 마을에서 빈농의 아들로 태어난 죽산은 일본 유학 이후 여러 새로운 서구사상에 눈뜨게 되고 초대 국회의 국회의원으로서, 또 헌법기초위원회 위원으로서 대한민국의 건국과 건국헌법 제정에 깊이 관여했으며, 그 후에 초대 농림장관과 제2대 국회부의장도 지냈다. 죽산은 조국 통일을 저지하고 동족상잔의 유혈극 재발을 꾀하는 극우와 극좌를 모두 부정하고 ‘제3의 길’을 추구했다. 죽산에게 있어 제3의 길은 헌법적으로는 바로 ‘사회민주주의’를 의미하는 것이었다. 이러한 죽산의 사회민주주의 사상에서 수정자본주의적 통제경제사상, 평화통일사상 등과 같은 죽산의 헌법사상들이 형성되고 구체화될 수 있었다. 본 연구는 이러한 죽산의 헌법사상들을 수정자본주의적 통제경제사상, 평화통일사상, 통치구조 규정들 속의 죽산의 헌법사상, 기본권 규정들 속의 죽산의 헌법사상으로 나누어 살펴본다. 이를 통해 죽산의 헌법사상들이 건국헌법의 제정 과정에 어떤 영향을 미쳤으며 현행헌법에는 어떻게 계승되고 있고, 앞으로 미래의 우리 헌법에서 어떻게 발전적으로 구체화되는 것이 바람직한지를 규명함을 연구의 목적으로 삼는다.

영문 초록

Cho Bong-Am was a politician who gave profound influence to Korean politics from the Japanese Intrusion period to the early days of the Republic of Korea. He was born in Kyong-gi province as a son of a poor farmer on September 25th in 1899, and was awakened to the various new western ideas while studying in Japan. He was deeply involved in the establishment of the Republic of Korea and its First Constitution as a member of Constitution-Drafting Committee as well as a member of the First Congress. Later, he also became the second Vice-president of the Korean Congress and the first Minister of Agriculture and Forestry. He denied both the extreme right and the extreme left which impede the unification of Korea and promote the war between the South and the North, and pursued ‘The Third Way.’To him, the third way meant ‘Social Democracy.’Under the social democracy idea, his planned economy idea in the Revised Capitalism and his peaceful unification idea could be built up and taken shape. This paper will examine the constitutional thought of Cho Bong-Am dividing it into the planned economy idea in the Revised Capitalism, the peaceful unification idea, and his constitutional ideas in the governmental structure and the constitutional rights. This paper aims at revealing on what kind of influences his constitutional idea gave to the First Constitution, how it was succeeded to the current Constitution, and, finally, how it will be desirably taken shape to the Korean Constitution in the future.
