국문 초록

정보통신기술의 혁신적 발전과 이를 통한 정보사회의 도래는 삶의 모든 영역에 큰 변화를 가져오고 있고 이는 정치 분야도 예외가 아니다. SNS(Social Network Service)와 모바일 통신기기의 대중적 보급으로 일상적 커뮤니케이션의 범위와 양이 획기적으로 확대되었고 전통적인 언론매체를 중심으로 한 의제설정과 여론형성의 구도가 변화하면서 수많은 사람들이 동시에 다양한 정치적 견해를 여러 방식으로 표현하고 교류하며 전파하는 현상이 일반화하고 있다. 이러한 상황은 물리적인 시ㆍ공간의 제약은 물론이고 여러 가지 사회적인 이유로 직접적인 의사소통이 쉽지 않았던 사회구성원들로 하여금 그러한 한계를 넘어서서 정보를 교환할 수 있도록 하는데 이는 기술적 수단을 활용하여 공적 교류를 통해서도 사적 친밀감을 경험할 수 있도록 한 것이다. 기술적 혁신이 구현해낸 이러한 새로운 매체환경의 진화과정 속에서 살아가고 있는 사람들에게 전통적인 의미의 사적 공간과 공적 영역에 대한 구분은 무의식적으로 혹은 의도적으로 의미를 잃거나 무시되는 경향이 있다. 일반 이용자뿐만 아니라 최근에는 종래 이른바 공적 업무로서 그 정치적인 중립성이 요구되고 또한 미덕으로 여겨졌던 분야의 종사자들도 일반 대중과 직접 의사교환이 가능한 SNS 등 매체를 활용하여 자신의 정치적 견해를 가감 없이 표명하는 모습이 일부 관찰되고 있다. 교육분야에서도 전통적으로 자라나는 세대를 가르치고 길러내는 교사의 역할은 법 이전에 정치적으로 초연한 입장에서 진리와 지혜를 전수하는 스승의 모습으로 사람들의 관념 속에서 기대되어 왔으나 일부 교사들이 개별적으로 혹은 집단적으로 정치적 의사표현에 나서는 한편 학생들을 직접 대하는 수업현장에서도 자신의 정치적 견해를 학생들에게 일방적으로 전달하는 상황이 파악되고 있다. 이러한 현상은 교사의 정치적 표현의 자유 문제와 함께 교육의 정치적 중립성의 의미에 대한 검토를 요구한다고 할 것이다. 이 글에서는 교육의 정치적 중립성이 지니는 헌법적 의의를 그 역사적 연원과 배경에 대한 인식을 토대로 검토함으로써 교사가 수업 중 시행할 수 있는 정치관련 교육의 성격과 개인으로서 정치적 표현의 자유 문제에 대한 이해를 확보하고자 한다.

영문 초록

Renovative development of information communication technology and its consequential advent of information society has brought great changes in all areas of life, and the field of politics is no exception. SNS(Social Network Service) and the popularization of mobile equipment significantly expanded the scope and quantity of everyday communication and the way of setting public agenda and forming public opinion, which had been centered around the traditional mass media, has altered; and it has become a general phenomenon that many people express, communicate and spread different political ideas at the same time. This circumstances enables the members of society who had difficulty in directly communicating their opinions due to various social matters including the restrictions of physical time and space to exchange information beyond those restrictions. And this has made feeling private intimacy through the public communication possible with the help of the developed devices of technology. For the people who live in the evolving circumstances of new media the traditional division of private sphere and public sphere tends to be unconsciously or purposedly neglected and considered meaningless. Recently, it is observed that not only the general users but also the people working in the field where political neutrality is demanded and is expected as a virtue, for the vocation’s public characteristics, express their political opinions unreservedly through the SNS media where direct communication with the general public is possible. In the field of education, the role of the teachers has been expected to be a politically disinterested one instructing truth and wisdom, yet some teachers are publicizing their political stance individually or collectively and are also transmitting their political opinions in the classrooms where they meet face to face with the students. This phenomenon needs an examination in relation to the significance of the political neutrality of education and the freedom of political expression of the teachers. This thesis examines the constitutional significance of the political neutrality of education based on the acknowledgement of its historical origin and background; then it attempts to understand the characteristics of possible classroom education concerning politics and the issue of the freedom of expression of teacher as an individual.
