국문 초록

자본주의의 근본적인 문제해결은 모든 학생이 부모의 재산이나 사는 곳에 상관없이 제대로 된 교육, 균등한 교육을 받도록 하는 것이 그 목표라 할 것이다. 이는 헌법상의 사회적 기본권의 최대과제라고도 할 수 있으며, 균등한 교육의 의미는 학력차이(교육격차)는 결국 소득 격차로 이어 지기 때문에 복지의 최대쟁점으로 이 격차에 대한 부분에 대한 헌법적 논의가 필요한 때이다. 이러한 논의는 우리나라만의 문제가 아니라, 자본주의 민주주의를 국가이념으로 설정한 모든 나라에서 정도의 차이는 있으나 동일하게 발생하는 문제일 것이다. 그 중에 우리와 교육제도와 문제가 비슷한 일본에서 교육격차 해소에 대한 여러가지 방안을 검토하고자 한다. 일본도 심각한 교육격차가 있는 국가로서 정부주도로 다양한 해결책을 제시하고 있다. 방안으로서 국가가 스스로 교육격차가 심각하다는 것을 스스로 인정하고 이를 위한 국가목표로 설정하고 적극적으로 대처할 필요가 있다. 또한 이를 위한 헌법적 근거를 구체적으로 제시되어야 할 것이다.

영문 초록

The problem solving which capitalism is basic all students property of the parents or the higher officer without in the place which lives well the education which becomes, in order is equal and to be educated, the fact that doing the aim means will do. This is a possibility even as the maximum subject of social fundamental right of constitution as a matter of doing, meaning the education which is equal the educational background difference (educational difference) when in order finally to be joined together with income difference with the maximum issue of the material the constitutional discussion needs about a part about this difference is. Like this discussion knows and problem of our country bay, from all countries which set a capitalistic democracy with national ideology difference of degree is but identically, will be a problem which occurs. Among the rest with us from Japan where the education system and problem are similar many kinds plan under investigating boil about education difference solution. As the nation which is the educational difference whose also Japan is serious presents the solution which is various with governmental leading. As plan the nation will be educational difference seriousness oneself and the thing oneself to recognize in the national objective for this and will set there is a necessity which will dispose actively. Also must be presented the constitutional ground for this concretely.
