다산(茶山) 정약용과 베카리아의 범죄와 형벌 사상 비교연구

국문 초록

근대 이후 계몽주의 형사법 사상의 선구자로서 베카리아는 「범죄와 형벌(Dei Delitti e Delle Pene)」(1764)이라는 저술을 통해 형벌권제한의 원리를 주장함으로써 형법을 종교와 왕권의 지배로부터 해방시키려고 하였다. 이러한 베카리아의 형사법사상은 죄형법정주의의 확립, 형법과 종교․도덕과의 구별, 범죄와 형벌과의 균형, 객관주의 범죄이론, 일반예방적 목적형주의 등 고전주의 형사법이론의 출발점이 되었다. 한편 이러한 서구의 형사법이론이나 사상은 우리나라 대부분의 형법 및 형사정책등의 교과서를 통해 흔히 접할 수 있는 반면, 우리 사회와 문화의 특수성이 반영된 사상과 법원리에 대해서는 소홀한 경향이 있다. 이러한 의미에서 18세기 이후 서구에서 고전학파를 필두로 한 형사법사상이 전개가 되었다면 동시대에 우리 한국 사회에서는 많은 실학사상가들의 개혁정치가 있었고, 형사법적인 측면에서도 정약용의 사상과 지도원리는 서구의 그것과 견줄만한 것이라고 할 수 있으므로 이 연구에서는 형사법사상의 근간을 마련해 준 베카리아와 정약용의 범죄와 형벌 사상을 비교를 통해 현대적인 의미에서 시사하는 바를 모색하였다.

영문 초록

Beccaria, a pioneer of the idea of enlightened criminal code, asserted the principle of 'limits of punishment' in his 「Crime and Punishment (Dei Delitti e Delle Pene)」(1764), endeavoring to free the criminal law from the control of religion and sovereign power. This criminological thought of Beccaria became the foundation of ‘nullum crimen, nulla poena sine Lege,’ as the beginning of the classical theory that addressed the classification of criminology or criminal-law from religion․morality, balance between crime and punishment, objectivist theory of crime, and general preventive, objective principle. These theories and ideas of criminal laws from the West are commonly introduced in most of textbooks concerning criminology or criminal-law and policies in Korea while the ideas and principles of laws that reflect the uniqueness of our culture seem to have been neglected. As the idea of criminal law emerged mainly by the classic school in the West in the 18th century, many of the contemporary realistic school in Korea proceeded with the political reform, and the idea and guiding principle of Jeong Yak-yong is regarded as significant as those of the West in terms of Criminal Law. This study, therefore, aims to provide the basis for the idea of Criminal Law and address the modern-day significance by comparing the ideas of crime and punishment of Beccaria and Jeong Yak-yong, the founders of the ideas in this regard.
