국문 초록

본 논문은 유가철학의 규범적 질서 체계로서 禮와 서양 사상에 연원을 둔 인권과 프라이버시 개념 사이에 함축되어 있는 의미 사이의 상관관계 또는 통약가능성을 해명하고자 하였다. 유가철학에서 禮樂은 정치적 상하 신분을 가진 사람들의 직분을 구별하면서도 동시에 정치적 통합을 목표로 한다. 이 점에서 禮樂은 한편으로 통치자가 백성들을 효과적으로 다스리는 수단의 측면에서 볼 수도 있지만, 다른 한편 피통치자들의 권리를 적절하게 실현해 주는 긍정적 기능을 하는 것으로 평가할 수 있다. 논어와 맹자에서 권리의 문법이 논의되는 맥락은 서양의 개인주의적 전통에서 권리가 논의되는 방식과는 다르다. 하지만, 권리에 대한 유가철학의 담론은 사회전체의 공적 질서로서 禮와 관련하여 지식인과 일반 백성들 사이에 맺어져 있는 권리와 의무의 상반된 상호관계를 규정하는 방식으로 이루어진다. 프라이버시와 연관하여 분석하는 한에서 禮는 특정 계층의 프라이버시의 범위와 특성을 한계지우는 역할을 한다고 할 수 있다. 요컨대, 유가철학에서 禮를 프라이버시와 결합하여 문제 삼을 때 중요한 것은 禮를 지키는 것은 바로 인격성을 지키는 것이며 이것을 통하여 프라이버시가 보호된다는 것이다. 이렇게 볼 때, 禮개념속에는 인권 및 프라이버시의 개념을 이끌어낼 수 있는 의미가 매우 복합적으로 내재해 있다.

영문 초록

In contemporary society, human rights and privacy are problems which have been very often discussed theoretically. This essay tries to examine which connections Confucian propriety[禮] and human rights and privacy have semantically. That is to say, it illuminates correlative meaning and commensurability between them. Propriety[禮] and music[樂] play an important role in Confucianism, which equalize the differentiated portion of social position and property of political upper and down classes. In this point, propriety and music can be primarily regarded as the method through which a ruler governs general people effectively, but on the other hand could be evaluated that which executes operation realizing properly right of the governed. The interconnection that grammar of right is discussed with in the Analects and Mencius is different from that which right is discussed with in individualistic tradition of west. When bring propriety into question in connection with privacy in Confucianism, propriety plays a role on which sets of limit scope and characteristic of privacy within special classes. In conclusion, being contemplated in connection propriety with privacy in Confucianism, what is important is that observance of propriety just abides by humanity, from which privacy is protected. In this point of view, complex meanings from which derives human rights and privacy are implied in the concept of propriety.
