영문 초록

This paper investigates the legal system of EU and the major traits that may be found in its arbitration system. One of the important players in the EU legal system is the Court of Justice of European Union whose structure is also introduced in this research. It was studied how the relationship between the EU courts and the national courts has been formed and which of the two sides of courts have superiority in delivering a final and binding decision to the parties of international litigation. The traits of arbitration that are considered as most important include party autonomy, arbitrability and the role of court in arbitration. Several unique characteristics that are found in each of the three typical traits in arbitration were suggested in this paper to provide international traders with rough guidelines that may be referred in their doing business with EU markets.
