집회시위 군중의 집합행동에 관한 연구

국문 초록

이 연구에서는 집회시위 현장에서 시위군중과 경찰 사이에 정면충돌이 발생하는 상황을 이론적 관점에서 조명해 보았다. 구체적으로는 ‘자원동원 이론’, ‘헌법조항의 충돌’ 등의 관점에서 양자가 정면충돌하는 상황을 심도 있게 고찰해 보았다. 이 연구의 결론에 따르면, (1) 집회시위가 개최될 때에는 집행부(주도세력)가 자극적인 선전선동으로 시위군중이 집합적 흥분상태에 빠지도록 만든다. (2) 집회시위집행부(주도세력)가 군중을 선동할 때에는 집권세력의 무능력과 무성의를 원색적으로 지적하는 방법을 사용한다. (3) 집행부(주도세력)가 군중의 폭력을 부추길 때에는 진압경찰을 권력의 하수인으로 폄하하여 적개심이 고조되게 만든다. (4) 집회시위군중과 경찰이 충돌하는 것은 집회시위 집행부(주도세력)가 의도적으로 먼저 위반을 저지르기 때문이다. (5) 집회시위의 집행부(주도세력)는 경찰의 대응수준에 관계없이 선제적으로 도발을 야기해 공권력의 발동을 자극한다. (6) 집회시위의 집행부(주도세력)는 경찰이 현장에 없어도 의도적으로 위반을 저질러 경찰이 어쩔 수 없이 물리력을 행사하도록 만든다. (7) 집회시위의 집행부(주도세력)가 선제적으로 위반을 저지르는 것은 경찰과의 충돌을 야기하여 특종거리를 만들어내기 위함이다.

영문 초록

Research findings could be summarized as follows: ⑴ Leaders of the demonstrating crowd make the assembled mob feel the collective excitement by instigative propaganda. ⑵ Leaders of the demonstrating crowd strongly criticize the incapability and reluctance of the current regime when they instigate the crowd, ⑶ Leaders of th crowd stir up the hostility of the crowd by underestimating the police as perpetrators of the ruling class. ⑷ Physical collision between the crowd and the police during the demonstration almost always takes place because of the demonstrating leaders’ provocation. ⑸ Leaders of th demonstrating crowd anticipatively violate the laws and regulations, expecting the active response of the police without regard to the level of law enforcement. ⑹ Leaders of the demonstrating crowd deliberately violate the laws and regulations even if the police is not present at the scene to bring about physical response of the police. ⑺ The reason that the leaders of the demonstrating crowd deliberately violate the laws and regulations is just because they want to have the mass media give a full account of report about their demands.
