해양범죄의 현황 및 그 대응방안

국문 초록

우리나라는 국토의 3면이 바다로 둘러싸여 있어 과거부터 해양이 단순한 해상교통로 및 군사적 목적으로 그 중요성이 강조되었으나, 현대 사회에 와서 해양이 지니는 중요성은 산업 및 경제의 발전, 과학기술의 발달, 그리고 사회 및 문화의 발전에 따라 더욱 높아지고 있다. 해양에서 가치창출 활동이 다양해지고 국내ㆍ외적으로 이해관계 대립이 높아짐에 따라 해양치안환경은 복잡해지고 있으며, 늘어나는 안전ㆍ보안에 대한 위협은 해양경찰 기능의 중요성을 강조하게 한다. 더욱이 해상교통량 증가 등에 따라 안전 및 해양환경 관련 치안수요가 지속적으로 증가하고 수산자원 고갈 등으로 해상범죄의 광역화ㆍ기동화ㆍ다국적화가 가속되고 주변국과의 경제적 수준차로 인한 밀입국ㆍ밀수 등 국제성 범죄와 해상안전 및 수산관련 범죄가 증가하고 있으며, 특히 2005년을 기점으로 범죄율이 대폭 증가하고 있다. 따라서 이 연구에서는 해양범죄에 적절히 대응하고 국민의 인권과 편의를 신장시키기 위해 수사인력 등의 확충, 수사역량의 확대, 수사제도 개선 등 세 가지 해양범죄 대응방안을 제시하였다.

영문 초록

The ocean in the 21st century is getting emphasized as a treasury of natural resources and a growth engine for the nation. And nations around the world have entered into the hyper-competition to take the initiative for those marine resources. By marine products resources exhaustion and so on wide areaㆍmovingㆍmulti-national of maritime crime accelerate and internationalism crime and sea safety such as illegal entry into the countryㆍsmuggling by economical level difference with the surrounding country and marine products connection crime increase and Korea Coast Guard’s role to augment. On top of that, it makes every effort to provide comprehensive maritime security services with high quality by catering to the increasing needs of maritime security and actively responding to a rapidly changing international marine environment. Korea Coast Guard ensures to protect sea from maritime crime and keep maritime security and peace. However, Korea Coast Guard’s degree of specialization on criminal investigation has been weaker than overland police’s. Therefore, this study suggests the countermeasures of Maritime Crime in Korea. The core suggestions are as following: First, Korea Coast Guard need to increase the number of specialists on the investigation police. And the professional education for investigation technique should be intensified. Second, crime investigation needs to be scientific. Third, investigation system devises ways to make more convenient for the public and to protect the human rights through police investigation activity.
