국제범죄의 새로운 양상과 그 대응방안

국문 초록

오늘날 국제범죄는 첨단과학기술의 발달과 세계화로 국가간에 신속하게 이동할 수 있는 범죄 기동여건이 조성되고 범행공간도 크게 확대됨에 따라 새로운 범죄양상을 나타내고 있다. 최근 국제범죄 발생사례와 선험연구 등을 토대로 분석한 결과 ➀ 사이버범죄, 보이스피싱, 산업스파이, 신용카드 사기 등의 신종범죄가 출현하고 ➁ 외국인범죄가 조직화, 지능화, 흉포화하고 있으며 ➂ 국가간 인적교류가 가속화되면서 국제매춘의 세계화 현상이 나타나고 있다. 그리고 ➃ 제 3국에서 귀순을 준비 중인 북한이탈주민들이 국제범죄에 연계되는 사례가 증가하고 ➄ 국제범죄조직간 연계도 강화되고 있는 것으로 조사되었다. 이에따라, 종합적인 대책으로 ➀ 국제범죄방지 기본법 제정 및 관계법률을 정비하고 ➁ 기관별로 분산되어 있는 국제범죄업무를 조정·통합할 수 있는 가칭 `정부합동 국제범죄방지센터`를 설치하며 ➂ 국제형사사법공조, 국제경찰협력, 정보기관간 범죄정보교류 확대 등을 통해 국제공조를 강화하는 한편, ➃ 과학적인 정보관리와 대국민 계몽·홍보활동을 강화하는 방안을 제시하였다. 특히, 제안된 대책이 성공적으로 이행되기 위해서는 ➀ 법정비 및 예산확보를 위한 위정자들의 노력과 ➁ `정부합동 국제범죄방지센터`는 부처 고유업무의 성격 및 위상 등을 고려하여 법무부 산하에 두는 것이 바람직하다는 점을 강조하였다.

영문 초록

Due to the rapid development in the transportation, communications & information-sharing system, today’s international crimes are taking different forms as they are more rapidly mobilized and have a wide range of crime activity territories in the world. According to the analysis based on the internal and external dynamics of transnational crimes and previous studies, ①new types of crimes, such as cybercrimes, voice phishing, industrial espionage, credit card fraud, are emerging; ②along with the increased number of foreigners entering and exiting the country, crimes involving foreigners are also becoming more organized, sophisticated, and cruel; ③the prostitution is taking advantage of the active personal exchanges across the globe; ④an increase in the numbers of transnational crimes in affiliation with North Korean refugees who are preparing to defect in a third country is appearing; and ⑤the enhanced correlation among the different international criminal organizations has been seen in the recent trends. Therefore, I proposed the effective countermeasures as follows: ①establishing the relevant laws and legislations to prevent international crimes, ②installing 'Joint Government International Crimes Prevention Center'(temporarily named) to coordinate and integrate the decentralized counter activities of the relevant agencies; ③strengthening international cooperation by enhancing international mutual legal assistance, international police cooperation, and an exchange of crime-related information among Intelligence agencies, as well as establishing 'Joint Crimes Control Entity for the Northeast Asia;’ and ④scientific management of relevant information and reinforcing various activities to raise public awareness. In particular, in order for the proposed countermeasures to be successfully executed, I emphasized ①the politician’s efforts to establish relevant legal foundation and to secure budget, as well as ②having the ‘Joint Government International Crimes Prevention Center,’ whose location can cause friction among agencies, under the Ministry of Justice considering its characteristics and reputation.
