국문 초록

본 연구는 지식기반도시육성을 위한 특별법의 제정방안에 관한 연구이다. 이러한 연구를 통하여 자치권보장의 실질화에 기여하고자 한다. 자치권의 보장을 강화하기 위하여서는 첫째, 규범적 근거의 마련, 둘째, 재정의 확충에 있다. 지방자치단체의 실정을 살펴 보면 거의 모든 자치단체가 재원확보의 방안을 가지고 있는 것이 아니다. 이는 곧 자치권의 보장 및 그 행사의 한계로 나타난다. 이러한 한계를 극복하기 위한 방안 중의 하나가 바로 특별법의 제정을 통하여 자치단체가 스스로 자족적인 재정확보가 가능한 지식기반도시조성 혹은 육성이다. 물론 반드시 특별법의 체계로 하여야 할 필요성이 있는가 하는 문제가 제기될 수 있을 것이다. 그러나 현행 자치권보장의 요구정도와 그 규범내용의 강도에 비추어 보면 그 실현이 가능한 특별법의 체제를 갖추는 것이 필요하다고 할 것이다. 특별법의 형식을 취함으로서 교육ㆍ문화ㆍ산업의 영역에 있어서 지식기반산업도시의 조성이 수월하게 된다. 이러한 규범적인 지원ㆍ육성을 통한 지식기반도시의 건설은 궁극적으로 자치단체의 재정의 자립을 실현하게 되며, 이를 통하여 자치권의 보장을 보다 강화할 수 있게 되는 것이다.

영문 초록

This is the study for the developmental plan of special law for fostering knowledge based city. We would like to contribute the practical securing autonomous right through this study. To strengthen securing autonomous right, the first thing to do is to prepare the rationales of norms and the second is to expand the finance. Considering the realities of local governments, not all of them have the plans to secure the financial sources. This causes the limitations of securing autonomous right and its implementation. One of the plans to overcome these limitations is to develop or foster the knowledge based city that enables the local governments to secure the finance to keep their autonomy, through the development of the special law. Of course, the question may come out whether it has to set the form of special law. Considering the requirement level of securing the current autonomy and its intensity of norms contents, however, it may be required to set the form of special law which the realization is possible. With setting the form of special law, the development of knowledge based industrial city makes easier in the areas of education, culture, and industry. The development of knowledge based city through this systemic support and fostering can ultimately realize the financial autonomy of the local governments, and further strengthen securing the autonomous right through this.
