국문 초록

구체적인 지표 없이 기본권의 성질에 따라 인간의 권리와 국민의 권리로 나누어 당해 기본권의 외국인 향유 주체성 인정여부를 결정할 것이 아니라, 기본권의 인적 보호영역을 넓게 보아 원칙적으로 그 주체성을 인정하고, 구체적으로 개별 기본권을 향유할 수 있는 외국인의 인적 범위와 개별 기본권에 대하여 어느 정도 인정하고 보호할 것인가의 물적 범위를 결정하고, 그 제한은 기본권 제한의 일반원칙에 따라 결정하는 것이 타당하다. 따라서 외국인도 기본권의 주체로서 인정되며 다만 개별 기본권 영역에서 제한의 법리로써 제한이 가능할 뿐이다. 특히 국민과 유사한 지위에 있는 외국인은 정주외국인과 동일한 개념으로서 출입국관리법상의 영주허가를 받은 자를 포함하여 대한민국에 자신의 국적국보다 더 깊은 생활상의 밀접성을 가지지만, 대한민국의 국적은 가지지 않은 자를 의미한다고 볼 수 있다. 이러한 국민과 유사한 지위에 있는 외국인에 대하여는 국민이 향유하는 기본권의 상당부분을 인정하는 것이 필요하고 타당하다.

영문 초록

Today the International relations are becoming increasingly interdependent, and universal human rights and the pursuit of democracy are taken for granted. Korea is regarded to have become a `multicultural society` considering drastic increase in its social and economic activities as well as increasing number of foreign resident and international marriage. Universal human rights must be guaranteed against foreigners, as well as means, they are a member of our community, local residents have also in the position we should keep in mind. From the perspective of the fundamental rights theory, without any concrete grounds, we should not separate the fundamental rights of human rights and the rights of the people by the nature only in giving rights to the foreigners but protect the basic rights of the human identity area and specifically exercise the voting rights of foreigners to the basic rights of human reach and then should be determined how much each ought to acknowledge the scope of protection. And the restrictions limit the fundamental right to decide on the general principles are valid. Therefore, it is logical for constant foreigners - including permanent residency who are living in the Republic of Korea with a favor - to admit to the suffrage, though they do not have the nationality of the party. We should acknowledge that `foreigners that they have the status like a nation` possess almost of the fundamental right of nation
