국문 초록

민주정치에서 선거는 경쟁적이다. 왜냐하면 그것은 선택가능성과 선택의 자유를 가져야 하기 때문이다. 그런 점에서 선거의 공정성은 선거과정에서의 정치적 경쟁의 공정성을 의미한다. 선거권자의 지지를 얻고자 하는 후보자 및 정당간의 경쟁은 편파적이거나, 뇌물이나 책동으로 영향을 받아서는 안 된다. 공정선거는 공리주의적 관점에서도 정당화되는데, 이에 의하여 선거결과가 그 참여자에게 수용되며 정치권력은 정당성을 확보하게 된다. 또한 공정선거는 정치시장의 불완전성에 기인한 정치적 독과점에 대한 안티테제로서 작용한다. 한국에서 지방자치가 실시된 지 20년이 넘었다. 그 나름대로 민주적 정당성을 갖추었다고 평가되지만, 여러 비민주적 관행과 불완전한 규정 때문에 지방선거는 끊임없는 논란의 대상이 되었다. 무엇보다도 작은 정당의 희생 하에 거대 정당의 정치적 독과점을 사실상 뒷받침해 왔다고 해도 과언이 아니다. 주민의 의사가 정치세력에 의하여 왜곡되고 무시되었던 것이다. 따라서 지방선거의 공정성 확보를 위한 입법방안이 요구된다. 그 주된 내용으로 규제의 강화보다는 정치적 경쟁의 강화, 공무원의 정치적 중립, 선거관리위원회의 엄격한 감시 등을 들 수 있다. 아울러 보다 정교한 선거체계의 구성이 요구된다. 적정한 선거구의 규모, 자유로운 입후보, 현직 여부를 떠나 모든 후보자에게 균등한 기회를 확보해 주는 선거운동방식, 자신의 정치적 선호를 표시할 수 있는 투표방식 등이 마련되어야 한다. 그리고 선거과정 및 정치과정에서 차지하는 정당의 중요성을 전제로 하여 지방정당의 설립을 허용하여야 한다. 보다 실질적인 정당간 경쟁이 선거의 공정성을 제고하기 때문이다.

영문 초록

In a democratic polity election is competitive, because it should have the possibility of choice and the freedom to elect. Fairness of election, therefore, means fair political competition in the electoral process. In fact, competition among candidates and political parties seeking for support of electorate should be impartial and unprejudiced, not being suppressed practically by bribery and maneuver, etc. Fair election is justified by an utilitarian perspective in that it makes participants in the electoral process accept the results and guarantees the legitimacy of political power. Besides it is required as an antitheses to political monopoly which necessarily results from the imperfection of political market. In Korea local autonomy has a history of more than twenty years. In spite of democratic legitimacy, local elections in Korea have been criticised because of many undemocratic practices and improper regulations. Above all, they practically serve for maintaining political monopoly of the bigger parties at the sacrifice of the smaller ones. Consequently, the will of people has been distorted and overriden by politicians. Therefore some guidelines should be pointed out to enhance fairness in the local election. Rather than strengthening regulations, reinforcing political competitiveness among candidates should be pursued first; keeping neutrality of civil servants; watching and overseeing the electoral process by the independent organization such as the National Election Commission. More elaborate components of electoral system are to be designed: proper district magnitude, free candidacy, fair chance of campaign that guarantees equal opportunities for all participants whether incumbent or not, voting system which enables each elector to express his/her own preference respectively, etc. For more fairness, recognizing the necessity of candidacy through political parties, establishing a political party on the local level is to be permitted. Because more effective interparty competition is necessary for the fairer process and result.
