영국 지방선거에서의 공정선거 확보방안

국문 초록

영국의 지방자치제도는 수백년의 역사적 전통속에서 매우 복잡한 체제를 유지해 왔는데, 최근 헌정현대화의 흐름속에서 지방자치개혁이 지속적으로 추진되어 왔다. 지방자치제도의 복잡성에 따른 한계에도 불구하고 지방선거제도는 자유선거를 원칙으로 하면서 선거비용 규제 등을 통해 공정선거를 구현하기 위한 제한적인 보완적 장치를 마련하고 있다. 유권자의 표현의 자유와 후보자와 정당의 선거운동의 자유는 최대한 보장하면서 금전적 불평등에 의한 과열선거를 방지하고 유권자와 후보자의 자발적인 참여에 기초한 자유로운 선거문화를 발전시켜 왔다. 선거관리인제도, 유급선거운동원고용금지, 선거감시인제도, 기부제한, 선거관리위원회제도 등이 그 주요한 특징이다. 특히 우편투표의 확대나 전자투표에 대한 실험과 같이 국민의 참정권을 확대하기 위하여 기술적 변화에 능동적으로 대응하고 있는 점이 주목된다. 물론 이와 같은 변화에 따른 선거부정의 우려가 없는 것은 아니지만 문제점에 대해서는 적극적으로 대처하면서 참정권의 확대와 자유로운 선택권의 가치를 최대한 배려하는데 인색하지 않겠다는 원칙을 확고히 하고 있다. 이는 선거에 있어서 자유와 공정의 두 가치 가운데 무엇이 원칙이고 무엇이 수단인지를 철저히 보여주는 태도라고 할 수 있다.

영문 초록

Local government system in Britain is very complex and diffused as a result of gradual institutionalization over the decades. Despite of these limitations, the principle governing local election has continued to be complied firmly with the first principle of election in liberal democracies: the election should be free and fair. Freedom of expression on the part of electorates and free campaigning of candidates are fully guaranteed in the electoral process with exceptional restriction focussed not only on the prevention of financial inequality but also on voluntary participation of electorates and candidates. Main features of local election regulation include election agent system, voluntary canvassing, election observer system, restriction on donations and gifts, cap on election expenses, and the newly established electoral commission and so on. In particular, the adoption and adaptation of information technology into the election process like the expansion of postal voting and introduction of electronic voting system can be noted. Although these new means of voting may cause new types of wrong-doings in election, the Britain seems to strike the balance in favor of the positive effect of new technologies towards the easy participation and free choice of voters. British way of maintaining fairness in local election verifies that election regulation for the purpose of fairness is envisaged to contribute to the maximization of free election so that it should not amount to the extent that free choice of electorates and free campaigning of candidates can be hindered excessively.
