정보기본권의 체계와 보장에 관한 연구

국문 초록

현대사회는 정보사회이다. 우리는 매체를 통하여 하루에도 수많은 정보를 접하면서 살고 있다. 컴퓨터와 네트워크 등 정보통신기술의 발전은 온라인을 이용한 사이버세계가 가능하게 되었고, 이로 인하여 우리는 정보의 홍수 속에서 생활하 고 있다. 이렇게 정보사회는 정보의 중요성이 증대되고 이를 바탕으로 정보의 생산, 유통과 이용을 통하여 새로운 가치를 만들어 내고 있다. 이렇게 사회가 정보사회로 발전하면서 정보는 인간의 삶에 있어서 필수불가결한 요소가 되고 있다. 정보사회의 눈부신 발전은 정보의 중요성을 더욱 각인시키고 그 가치를 증대시키고 있다. 왜냐하면 정보의 유통과 이용으로 발생하는 이익은 정보가 재화로서의 가치를 가진 대상이라는 것을 의미하기 때문이다. 그러나 정보사회가 밝은 면만 보여주는 것은 아니다. 정보의 활용을 통하여 이익을 가져다주지만, 정보의 오·남용으로 인하여 피해를 주기도 한다. 특히 개인정보의 유출 내지 오⋅남용으로 인하여 발생하는 피해는 정보사회가 보여주는 어두운 면이다. 오늘날 정보가 우리 삶에 미치는 영향이 지대하다는 점에서 헌법상의 하나의 기본원리로 정보국가원리가 논의되고 있고, 소위 정보기본권의 보호문제가 전면에 부상하고 있다. 그러나 우리 헌법에는 정보와 관련하여 직접적인 명문의 규정은 없다. 그렇지만 정보와 관련하여 개인정보의 보호는 사생활의 비밀과 자유에서, 정보의 접근과 취득 등 알 권리는 언론의 자유에서 포섭하여 보호하고 있다. 나아가 헌법은 열거되지 않은 권리도 헌법차원의 권리라면 보장해야 할 것을 규정하고 있다. 그렇지만 이런 규정들이 정보사회의 발전으로 인하여 다양하게 등장하는 권리들을 보호하기에는 한계가 있다. 더구나 개인정보의 경우 날로 그 침해의 심각성이 커지고 있다는 점에서 유럽연합헌법과 같은 명문의 규정이 도입되어야 할 필요성도 고려해야 한다. 아무튼 이 시점에서 정보사회에 중요한 기본권으로 등장한 정보기본권에 대한 체계를 확립하고 그 보장의 정도를 강화하는 것이 필요하다

영문 초록

Modern society is an information society. People are exposed to thousands of information even in a day through media. The development of information and communication technology, which is represented by computer network, has enabled an on-line based cyber world, which draws people into flood of information. In an information society, the importance of information becomes bigger and new values are created through the production, distribution and usage of information. Information is becoming a vital part of human life. As mentioned before, the development of information society has boosted the importance and value of information, since the benefit accrued by the distribution and usage of information indicates that information is a good with certain value. However, information society has its dark sides as well. Misuse and abuse of information do damage to people. Especially the damage caused by personal information leak, misuse and abuse are among the darkest sides. Due to the enormous influence that information has on our lives, 'the principle of information state' is being discussed as one of the basic principles in our constitution. Furthermore, the issue of information protection is rising to the front. However, our constitution does not have an express provision regarding information. Currently regarding the information issue, personal information is protected by the freedom and privacy of private life, and the right to know is protected by the freedom of speech. The constitution states as well, that even rights that are not enlisted in the constitution should be granted protection, if they are constitutional. However, it is deemed insufficient that these provisions protect the various rights rising from the development of the information society. They have certain limits. Moreover, in the case of personal information, considering that violation of it is getting more and more serious, we should consider the possibility of introducing an express provision about the issue, as the European Union has already done. At this point, to establish a systemic information basic right and to reinforce the degree of guarantee for it are in strong need.
