국문 초록

본 연구의 목적은 지적학의 접근방법을 중심으로 토지소유권의 입체적 범위를 법적으로 검토해보고자 하는 것이었다. 연구대상을 토지소유권의 입체적 범위로 한정하였고, 시간적 범위는 1992년부터 현재까지로, 내용적 범위는 토지소유권의 입체적 범위를 법적으로 검토하는 것으로 한정하였다. 연구방법으로 접근방법은 법률적 접근방법을, 조사방법은 문헌조사법과 인터넷조사법을, 분석방법은 기술적(記述的) 분석법을 사용하였다. 연구 결과, 지표를 중심으로 한 토지등록 형태에서 벗어나, 구체적으로 상하 효력범위를 설정한 후 이를 공적장부에 입체적으로 등록하기 위해서는 지적학 이론을 토대로 지적학의 접근방법에 의해 범위 설정이 가능할 것이며, 그 법적 근거는 토지의 조사ㆍ등록에 대한 기본법인 ‘지적법’이 되어야 함을 주장하였다. 또한, 효율적인 토지관리와 소유권을 보호하고, 토지의 상하공간에 대해 입체적 범위를 설정하기 위해서는 이에 대한 지속적인 법ㆍ정책적 연구, 등기제도의 정비 등과 같은 절차적인 연구가 병행되어야 할 것으로 판단되었다.

영문 초록

The purpose of this study was to legally examine three dimensional scope of land ownership based on Cadastrology approach. Study target was limited to three-dimensional scope of land ownership. The scope of time was set from 1992 to the present. The scope of contents was limited to legal examination of three-dimensional scope of land ownership. As a method of administrative approach, legal approach was used. As for the research method, literature research and internet search were used, and a method of descriptive analysis was used for analysis. As a result of the study, in order to set the concrete upper and lower scope of effectiveness and to register this to the official register book, deviating from existing indicator-oriented land registration, scope could be set with the cadastrology approach based on cadastrology theory. This study also asserted that its legal ground must be ‘cadastrial law’ which is the basic law for research and registration of land. Furthermore, in order to efficiently manage land, protect ownership and to set three-dimensional scope for upper and lower space of the land, procedure-related studies such as studies on laws, policy and improvement of registration system must follow.
