국문 초록

  물류의 구성요소로서 해상운송경로는 연안과 국제수역을 막론하고 그 중요성이 크다. 우리나라는 북한을 통과하여 유럽대륙으로 향하는 Brock Train 개설을 위해 노력하고 있으며, 해상에서는 남북간의 해상운송이 원활히 수행되고 있다. 북한선박이 제주해협을 통과한 것은 장기적으로 한반도의 정치적 안정과 물류체계에 영향을 끼칠 수 있을 것이다. 제주해협은 한국의 영해법상 남한의 관할권이 적용되지만 유엔해양법상 국제항행용 해협이라는 두 가지의 기준을 들이댈 수 있는 곳으로 한국이 설정한 영해법과 해운합의서, 유엔해양법에서 명시한 무해통항권, 통과통항권의 해석에서 있어 첨예한 대립을 빚을 수도 있다. 북한선박에 대해 국제적 기준을 적용하여 제주해협 통과를 허용한 것은 남북 화해ㆍ협력의 시대를 맞아 서로를 교전상태에 있는 적성국 또는 교전단체로 보지 않겠다는 의지의 표명과 함께 서해에서의 남북어업 협력을 통해 한반도의 평화정착에 공헌할 것으로 기대된다.
  제주해협의 통항제도와 관련되어 무해통항권(無害通航權, right of innocent passages)과 통과통항권 (通過通航權 transit passage)중 어떤 것이 현실적이고 또 국익에 유리한가 등을 살펴 향후 한반도를 통한 국제수송과 궁극적 상호발전을 도모하기 위한 검토가 필요하다.

영문 초록

  South Korea has applied the international sea passage protocols to North Korean ships passing through the Jeju Channel. This will send a message that in this age of cooperation and peace South Korea will not consider North Korea as an enemy. In addition, the cooperative relationship between South Korea and North Korea regarding fishing in the Yellow Sea is a promising sign for the future of the two Koreas.
  Undoubtedly, this is expected to contribute to the establishment of peace in the Korean Peninsular. On the other hand, there is a voice of concern that given that the transition from the truce state to the peace state has not yet materialised, South Korea has made too many premature political and economical concessions to North Korea.
  The Jeju Channel is international and therefore it is subject to the right of transit passage. However, as an alternative passage exists in the southern part of Jeju Island, according to the United Nations Convention on the Law of the Sea, the right of innocent passage cannot be denied. By the same token, North Korea might also demand the right of transit passage of North Korean ships including warships and submarines, and military aircraft through the Jeju Channel. In response to this plausible demand from North Korea, South Korea must formulate a counter argument.
  It seems inevitable that the existing laws of the sea in relation to the Jeju Channel transit protocol should be reviewed and amended based on the pros and cons of the right of innocent passage and transit passage against the national interests.
