집단적 노사관계법상 선원의 권익개선에 관한 연구

국문 초록

  그동안 해상노동에 있어서 우리나라 선원들의 권리향상 대책이 다소 가볍게 다루어져 왔고, 더욱이 선원직에 대한 사회적 가치관의 하락으로 선원수가 급속히 감소되어 왔다. 또한 해상근로관계는 육상근로관계와 달리 현행 노동관계법을 직접 적용하기에는 해상노동의 특수성에 따른 장소적ㆍ시간적 제약을 받게 되어 선원의 권익을 제한하고 있는 실정이다. 따라서 노동법의 집단적 노사관계법을 현재 우리나라 선원들의 노동현장에 적용함에 있어서 현실적으로 합리성이 결여되고 있는 점, 특히 단체행동권, 조합원자격, 선원노동조합의 회의기능 등에 관한 문제점을 파악하고 그에 대한 개선책을 제시하여 선원의 집단적 노사관계법에 관한 권리를 보호하는 것이 필요하다.

영문 초록

  Seafarers are being applied to the Seafarer"s Law, in relation to the protection of right, which is especially established on the basis of the Labor Standard Act and the Labor Laws. However, there is still insufficient work protection, and also the Labor Laws of crew which follows peculiarity of sea work is limitative. This acts as a primary factor of evading of seafarer as an occupation. In other words, this is concerned with a mixed factor as social and international competition, discrimination of social system and suffrage, limitation for the collective Act right, job composition"s boundary. It appeared to a reason that Korean seafarers have evaded labor at sea and limited the right for the collective Labor and Management Laws.
  As a matter of fact, seafarers" protection policy is negligent compared with the importance of marine transportation and fishing business. The improvement of individual labor conditions of the seafarer is being stagnant because it does not improve the problems to which collective labor relates. Thus, legislation policy must be improved to cultivate and Korean seafarers for comfortable and efficient transportation at sea.
  This paper reviews the actuality on the Collective Labor and Management Laws and proposes their modification and reform measures.
