학술저작물 유통과 저작권 보호에 관한 연구

국문 초록

  이 연구의 목적은 학술저작물의 온라인 이용 양상과 현황을 중심으로 현행 저작권법상 저작권 보호 측면에서 이미 발생하였거나 발생할 가능성이 높은 문제점에 대하여 진단함으로써 학술저작물의 불법 유통 및 전송에 따른 대책 등 개선방안은 무엇인지 살펴보는 데 있었다. 이를 위하여 연구자는 다음과 같은 세 가지 연구 문제를 설정하였다.
  첫째, 학술저작물의 저작물로서의 특성은 무엇이며 그것의 온라인 유통 과정에서 발생하고 있는 문제점은 무엇인가?
  둘째, 한ㆍ미 자유무역협정(FTA) 체결 등 새로운 저작권 환경에 따라 예상되는 저작물 유통상의 문제점은 무엇인가?
  셋째, 학술저작물의 적법한 유통을 위한 개선방안은 무엇인가?
  저작권법은 “저작자의 권리와 이에 인접하는 권리를 보호하고 저작물의 공정한 이용을 도모함으로써 문화의 향상 발전에 이바지함을 목적”으로 제정된 법률이다. 특히, “학문과 기술을 아울러 이르는 말”이며 동시에 “학문의 방법이나 이론”을 다루는 ‘학술’에 속하는 저작행위 및 그런 행위의 결과로 나온 학술저작물은 그것이 연구자의 독창적인 연구 결과임에 틀림없는 한 저작권법의 보호를 받는 저작물이다. 다만, 그것의 내용이 지극히 만인 공유의 진리 또는 방법을 다룬 것이라면, 이용자가 허락을 받지 않았다 하더라도 저작자의 독창적이고도 구체적인 표현을 복제한 것이 아니라면 저작권 침해를 주장하기 어렵다.
  결론적으로 연구자는 학술저작물의 적법한 유통을 위한 개선방안으로 계약 형태에 따른 방안과 아울러 합리적인 대안으로서의 저작권집중관리를 제안하고자 한다. 특히, 학술저작물이 가장 많이 생산되는 학술지의 경우 그것을 발행하는 학회가 먼저 저작권 보호의식에 입각하여 논문 제출자들과의 합리적인 관계를 맺어야 한다. 그 중에서도 회원들의 자발적인 의사에 따른 개별적인 동의 방식은 저작재산권을 양도하거나 신탁할 수 있는 유효한 방식이며, 특정학회가 자체에서 발행하는 학술지에 게재된 학술저작물에 관한 저작재산권을 적법하게 행사할 수 있는 유효한 방식이다.
  저작권법에 의한 강제 이전에 학술저작물에 담긴 연구성과로서의 구체적 표현은 일반적인 만인공유의 과학적 법칙이나 이론과 분리하여 제대로 보호되어야만 하며, 이렇게 학술저작물에 대한 보호의식이 국민적 공감대 속에 확고하게 정착될 때 문화와 학문이 고루 발전할 수 있을 것이다. 학회 및 학술단체가 연합하여 학술저작물의 바람직한 생산을 위한 구체적인 저작권 보호지침을 마련하고, 이를 바탕으로 개별 학회와 연구자들의 실천이 뒤따른다면 보다 투명하고 합리적인 학술저작물 이용 환경이 구축될 수 있을 것이다.

영문 초록

  Focusing on the aspects and practices of academic writings in on-line use, this study aimed to review existing or potential issues from the angle of copyright protection within current framework of Copyright Act, and thereby seek possible remedial solutions including countermeasures against any illegal distribution and transmission of academic writings. To meet these goals, this study posed the following three questions :
  First, which characteristics do academic writings have as copyright work? And what problems are there in the on-line distribution of those works?
  Second, what problems would there be in the distribution of copyright works under the influence of emerging copyright environment including conclusion of KOR-US Free Trade Agreement(FTA)?
  Third, what are the possible solutions for legitimate distribution of academic writings?
  Copyright Act is a law enacted “in order to protect author"s rights and related rights, and promote fair use of copyright works in the interest of contributing to improving and developing culture.” In particular, academic writings, which refer to “both learning and technology" and writing activity or resulting product as well in the framework of ‘science" dealing with “academic methodology or theory", belong to copyright works under the protection of Copyright Act, if it is definitely an original finding of researcher. However, if it contains any extremely universal truth or approach, or doesn"t copycat any original and detailed expression of author, we can hardly claim
for infringement on copyright, although any user employs it without permission.
  Conclusively, in terms of possible remedial solutions for legitimate distribution of academic writings, this study proposes some solutions based on copyright agreement type, as well as collective management of copyright and related rights as a rational alternative solution. In particular, in terms of journal as the most typical source of academic writings, it is required that academic society as journal publisher should have rational relationships with thesis contributors on the basis of copyright protection ethics. Above all, individual agreement based on voluntary idea of membership is considered valid in the transfer or entrustment of intellectual property, and also valid for certain academic society to legitimately exert its intellectual property to academic writings contained in its own academic journal publication.
  Before legal enforcement based on Copyright Act, it is necessary that detailed expressions as research achievement contained in academic writings should be properly protected apart from general and universal scientific laws or theories, and when this sense of protection for academic writings is established firmly in nationwide consensus, it is expected that our culture and academics will be developed in harmony. It is advisable that academic societies and bodies cooperate with each other to develop further copyright protection guidelines for favorable production of academic writings, and their cooperation should involve copyright protection practices of individual society and researchers, so that we will be able to create more transparent and rational environment for using academic writings.
