일본의 내각법제국의 헌법적 기능

국문 초록

  본고에서는 일본에 있어서 내각의 법률안제출을 둘러싼 헌법상황을 고찰함으로써 입법과정에 있어서 내각 및 내각법제국의 기능적 중요성을 강조하고, 나아가 내각의 보조기관인 내각법제국의 연혁 및 그 관장사무와 헌법체제의 변천과정을 살펴봄으로써 그 헌법적 기능을 파악하고자 한다.
  내각법제국은 주로 법령안에 대한 심사사무와 법률문제에 관한 의견사무를 관장하지만, 법률문제에 관한 국회답변·정부의 통일적 견해의 작성도 그 중요한 직무의 하나로 들 수 있다. 내각법제국의 심사사무는 각 성청이 입안하는 내각제출법률안 등에 대하여 헌법 및 법체계 전반과의 정합성 등의 관점에서 엄격하게 행해진다. 이러한 심사뿐만 아니라 법률의 해석에 관한 각 성청으로부터의 조회에 대하여 문서로 회답하는 법제의견은 의견 사무의 대부분을 차지하고, 정부ㆍ내각 내부에서는 최고재판소의 판례에 준하는 기능을 수행하고 있다. 따라서 내각법제국은 그 심사사무의 위헌심사적 기능 및 의견사무의 준판례적 기능 등을 통하여 이른바 헌법질서의 형성·유지기능을 수행하는 “일종의 헌법보장기관”으로 파악할 수 있을 것이다.
  끝으로 본고에서 고찰한 내각법제국의 기능 및 역할에 대하여는 주로 행정학에서 관료제연구의 일환으로 행해져 왔지만, 앞으로는 입법학에 대한 공법적 및 기타 법률학적 관점에서의 접근이 필요하다는 점을 지적하고자 한다. 물론 한국의 법제처에 대하여도 그 외예는 아니라 할 것이다.

영문 초록

  The purpose of this study is to clarify the constitutional Function of the Cabinet Legislation Bureau which is a subsidiary organ of the Cabinet by considering the constitutional situation of the bills presented by the Cabinet, its origin and the change of the task in the constitutional history in Japan.
  The Cabinet Legislation Bureau takes charge of examination work which examines legal plans and opinion-giving work which is concerned with legal issues mainly. Also it has the important function to make reply to the questions by the members of the Diet related to legal issues and the unified view of the Cabinet. The examination work for the bills presented by the Cabinet is performed strictly from the point of view of the consistency with the constitution and the whole system of Japanese law. In addition, the legal opinion concerned with Constitutional and legal interpretation for holds most of the opinion-giving work, and it has the function of an associate precedent of the Supreme Court in the Government. Therefore, we can treat the Cabinet Legislation Bureau as a kind of “the engine for the constitutional security” which carries out what is called the formative function of constitutional order through the opinion-giving work and the examination work.
  Lastly, studies on the function of the Cabinet Legislation Bureau have been performed as a part of bureaucracy studies in political science mainly, but studies from a point of view of public law related with legislative studies are necessary from now on. Such a point will not be the exception in studies for Korean Ministry of Government Legislation either.
