국문 초록
미국의 affirmative action은 가장 오랜 역사를 가진 국가주도의 사회통합형 공공정책으로 역대 행정부의 정치적 성향에 따라 정책의 향배가 결정되는 민감한 정치적 사안이기도 하다. 시행 초기에는 그 취지와 적용대상이 협의적으로 해석됐지만, 시간이 흐르면서 적용 대상과 범위도 확장되어 사회 전체 영역에서 이루어지는 차별의 문제를 해소하는 성격을 띠게 되었다. 또한 공공정책의 하나로서 적극적 차별 수정 정책은 공정성에 대한 시시비비를 법정에서 가리게 되었는데 사법부 최고법원인 연방대법원이 정책의 흥망성쇠를 결정하였다. 예컨대 대학입학정책에서 특정 인종에게 일정한 입학정원을 할당하는 쿼터제와 수치적 목표 추구와 같은 형태의 입학우대정책은 위헌 소지가 크고, 특정집단에 대한 집단우대와 같은 배려도 사회적 합의에 도달하기 어렵다는 것을 알 수 있었다. 이와 관련하여 최근 한국도 한국에 거주하는 외국인, 혼혈인, 이민자와의 결혼 가정에 대한 다양한 교육정책을 쏟아 내놓고 있는데, 정책 입안과 시행의 최우선 순위를 사회적 합의 도달 가능성에 맞춰야 할 것이다. 예컨대 대학 입학정원 할당제와 같은 입학정책은 위헌의 소지가 크지만, 교육 바우쳐(educational voucher)의 운영, 학습장애자에 대한 지원, 의료제도와 아동보호에 대한 동등한 지원 등은 실질적인 지원과 도움이 되고 사회적 합의에 도달할 가능성이 높은 것으로 사료된다. 이밖에도 장기적인 관점에서 정책의 개발과 시행도 중요하지만 시민들에게 학교, 지역사회, 언론매체 등을 통해 다문화 및 다민족 교육(cross cultural and diversity education) 프로그램을 지속적으로 시행할 필요성이 있다.
영문 초록
Recently Korean government draws up plans to give a variety of advantages to the mixed bloods and foreigners who have lived in Korea as their numbers have increased dramatically. The government has begun to listen to their voices and to be concerned about their human rights. This situation is not exceptional in a global world.
Those plans include the university"s admission and quota policy and expansion of special education for the mixed bloods and foreigners. The Korean Government"s affirmative action programs are timely and have positive meanings in themselves. However, despite the government"s good intentions, its plans seem to have some problems and implications when they are compared with the affirmative action policies in the United States.
First, the Supreme Court in the United States ruled that the admission quota system of state-run universities is unconstitutional. The Court also clarified that they are not allowed to allocate particular people to the universities intentionally just for American minorities. Recently Korea also plans a variety of the group preferences including the quota system of university admissions even though such means are considered a controversial policy between preferred and non-preferred groups. Fundamentally, however, this is a problematic rationale and needs to be studied more thoroughly.
Second, Korean government"s affirmative action for the mixed bloods and foreigners can result in a deep-seated feeling that Korean affirmative action programs are not a device to eliminate discrimination against minorities in Korea but a means of discriminating against Korean people. U.S. has experienced such a feeling and confirmed the widespread impression that minorities and white women have hopped on a government-protected, quota-fueled gravy train(Anderson, 2004). Now it is time to provide substantial helps for them, including supply of educational voucher, equal medicare treatment and child-care system, and special education for the learning-handicapped.
Third, Korean government ought to keep in mind that such policy and programs should not be temporary. Just as the affirmative action programs in the United States have experienced a number of side effects, so Korea can face similar results. There is a distinction between segregation and discrimination. American affirmative action programs, which have implemented since 1960s, give Korea valuable and rich implications. In that respect Korea should design and develop a variety of curriculum related to cross cultural and diversity education.
