영문 초록

  The existing criminal procedure law already has some regulations about the preparing procedure of criminal trial. But recently the Ministry of Justice presented a bill for amending the criminal procedural Act to the The Legislature. The reform bill is build around contents that the Presidential Committee on Judical Reform had prepared. The core of the Draft for the Revision of Criminal Procedure Law is realization of the system centering around trial. Specially the reform bill has wide and detailed regulations about preparatory proceedings on the trial.
  In principle preparatory proceedings on the trial does not justify its existence, because it comes into existence for the speedy judging at the a date for hearing. Therefore preparatory proceedings is a method for the realization of the system centering around trial. If too many things is done in the preparatory proceedings, the proceedings at the a date for hearing can become a mere scrap of paper.
  But the preparatory proceedings in the existing Criminal Procedure Law is very intricate in procedure and contents. The reform bill put the too heavy load to the entire system of criminal proceeding caused by wildly many regulations about preparatory proceedings on the trial.
  It is better to eliminate regulations in the reform bill which have conflict and contradictions to the current regulations about the preparing procedure.
