영문 초록

  The Internet revolution highlights the clash between the freedom of speech and the defamation law in korea, which emphasizes the importance of personal reputation.
  The advocates of free speech in Korea, who are impressed with the defamation laws of the U.S. focusing on protection of free speech, have suggested that the korean courts should also distinguish a public figure from a private figure and establish a firm standard for balancing freedom of speech with protection of individual reputation, in order to avoid a chilling effect on speech while promoting public discourse. Furthermore, in todays internet age, it is argued that Defamation, especially in an Internet defamation cases should be decriminalized because of its benefit to democracy, tendency towards globalization accelerated by Internet, and possibility of self-regulation, etc.
  But this article shows that individual honor and reputation are to be protected largely under the Criminal Code and Civil code, also from Online defamation. Because not only freedom of speech but also personal reputation contributes to the realizing of truth, democracy and selffulfillment. Harmonization between Korea and other countries more focusing on protection of free speech ―the United States, for instance― could be achieved by the resonable interpreting article 2-7 of the korean criminal code regulating the jurisdiction over crimes and by the legal policy aiming at legal pluralism and interlegality.
