국문 초록

본 연구의 목적은 지목판례의 실태를 조사ㆍ분석하고 이를 토대로 지목분쟁의 유형과 원인을 규명함으로써 지목분쟁에 대한 대책을 제시하는데 있다. 이상과 같은 연구목적을 효율적으로 달성하기 위해 연구범위를 시간적으로는 1960넌부터 2004년 4월까지로 하고, 공간적으로는 대법원의 판례로 한정하며 내용적으로 지목분쟁을 중심으로 한정한다. 본 연구의 접근방법은 역사적 접근방법을 사용하고, 조사방법은 문헌조사법과 판례조사법을 병행하며, 분석방법은 記述的 分析法을 사용한다. 분석 결과, 지목분쟁의 유형에는 지목변동과 관련된 분쟁, 지목 불부합에 관련된 분쟁, 토지가치에 관련된 분쟁으로 나타났으며, 원인으로는 대상 토지에 대한 물리적 하자, 관계공무원의 실질적 조사활동 부재, 지목변경에 관련된 관계법령의 충돌, 토지소유자들의 불법적인 용도변경으로 나타났다. 이를 해결하기 위한 대책으로는 지적공부와 실체관계의 일치, 지목제도에 대한 공신력 인정, 지적법에 지목관련 법률조항을 추가할 필요가 있는 것로 나타났다.

영문 초록

The purpose of this study is to investigate actual conditions of land category cadastral case, and to propose a solution of the land category conflicts based on the acquired data of the reasons/types on land category conflicts. For the efficiency, I had limited the periodic scale to 1960- April 2004, the spatial scale to the supreme court and the targets to land category conflicts. It had been performed by investigating the literatures / the cases and analysing comparatively in a historical approach altogether. As a result of analysis, the types at the land category conflicts consisted of a conflicts related to alteration of the land category, to disagreement of the land category, conflicts related to price of the land, and the reasons consisted of a physical defectiveness of the land, a lack of actual inspection of a public servant in charge, a diverseness between related regulations, a illegal change of the land category. It seems there should be a correspondence between the catalogue of the land category and the actual conditions, a recognition of the land category system, a establishment of additional provisions in the law of cadastre.
