국문 초록

본 연구는 지적제도의 불합리성에 관한 실태를 분석하고, 이를 토대로 지적제도의 합리성제고를 위한 방안을 제시하는 것을 목적으로 한다. 연구목적을 효율적으로 달성하기 위한 연구방법은 토지조사 이후 수원시의 지적관련 민원 불편사례를 조사하여 실제로 어떠한 유형들이 얼마나 있는지를 기록조사법과 사례조사법을 통해 최근 10년간의 업무처리결과를 가지고 분석하였다. 실태분석결과 지적제도 자체의 문제, 제도운영상의 문제, 빈번한 토지이동과 도시의 급격한 팽창으로 인한 문제점이 나타났다. 따라서 "지적특별회계"를 설치하여 "지적재조사사업"을 적극추진하고 "국가기준 점망을 재구축"하여야 하며, 지적업무 관장기관을 "지적관리청"으로의 통합 및 "토지공시법"을 제정 시행하여야 하며, "지적법상 행정구역 변경관련 규정을 신설"하고, 지목의 설정ㆍ변경에 따른 특별법을 제정하고 지적전문인력을 확충하여야 할 것으로 나타났다.

영문 초록

The purpose of this study is to analyze and evaluate the Irrationality of the cadastral system, and the research scope is to analyze both cases caused by a mistake from the cadastral system itself and problems caused by the cadastral system, as well as to analyze the problems caused by the frequent change of land and fast expansion of a urban area as a content analysis with the case study method. In the scope of the times, this research covers from the foundation period of the land survey project to the present time. To process the spacial scope of this research, Suwan City was selected as a case study. The results of this study are as follows. Firstly, the target land needed correction of the registration particulars should be adjusted promptly by establishing the Special Accounting System for the Cadastral Affairs in order to solve an incongruous site problem in the cadastral system, and we must change the system from a small reduced scale to a large reduced scale method (numerical value cadastral system). Secondly, with the integration of the related cadastral survey and registration afffairs organizations, the related laws and regulations should be also integrated in addition, the Public Announcement Law for Land should be enacted and enforced. Thirdly, with the improvement of the related cadastral systems and regulations, we must establish the iegulations on the change of the related administrative district on the basis of the cadastral law and introduce the new establishment of the functional land classification system for various purposes by enacting the special law in accordance with the settlement and change of the land classification system.
