국문 초록

스포츠기본권의 헌법상 제정 이유는 여러 가지가 있으며, 이를 통해 국민의 건강 증진, 사회적 통합, 개인의 자아실현 등을 촉진할 수 있습니다. 스포츠 활동은 신체적 건강을 증진시키고 질병을 예방하는 데 중요한 역할을 합니다. 헌법에서 스포츠기본권을 명시함으로써 국민이 건강한 삶을 영위할 수 있도록 지원합니다. 왜냐하면 국가는 정책적인 측면에서 헌법이 기속될 수 밖에 없기 때문에 향후 입법을 하는 방향성들이 헌법상 스포츠 기본권을 보장하는 방식으로 진행될 것이기 때문이다. 이러한 입법을 통해 스포츠는 다양한 사람들을 하나로 묶는 강력한 도구이며, 이를 통해 사회적 연대감과 통합을 촉진하고, 사회적 갈등을 줄일 수 있습니다. 또한 헌법상 권리로서 스포츠 활동을 사회적인 측면에서 보장하면 모든 국민이 동등한 기회를 갖고 참여할 수 있게 됩니다. 이를 통해 스포츠 활동은 개인의 성취감과 자아실현에 중요한 기회를 제공하고, 이는 개인의 정신적 건강과 행복을 증진시키는 데 기여합니다. 이를 통하여 스포츠는 문화의 한 부분으로서 사회의 다양한 문화적 가치를 증진시키는 역할을 합니다. 더불어 헌법에서 이를 보호하고 장려함으로써 문화적 다양성과 풍요로움을 더할 수 있습니다. 마지막으로 산업 발전의 측면에서 스포츠 산업은 중요한 경제적 가치를 지니고 있습니다. 이를 통해 일자리 창출, 관광 유치 등 다양한 경제적 혜택을 얻을 수 있으며, 국제 스포츠 대회에서의 성공은 국가의 이미지를 높이고 국제적 위상을 강화하는 데 도움이 됩니다. 헌법에서 스포츠를 장려함으로써 이러한 목표를 지원할 수 있습니다. 따라서 스포츠기본권을 헌법에 명시함으로써, 정부는 국민의 스포츠 참여를 촉진하고 이를 위한 정책적, 재정적 지원을 제도적으로 보장할 수 있습니다. 이는 궁극적으로 국민의 삶의 질을 향상시키고 건강하고 활기찬 사회를 만드는 데 기여할 것입니다.

영문 초록

The establishment of the constitutional right to sports has various reasons, through which it can promote the enhancement of public health, social cohesion, and individual self-realization. Engaging in sports activities plays a crucial role in improving physical health and preventing diseases. By explicitly specifying the right to sports in the constitution, it supports citizens in leading healthier lives. Moreover, as legislative actions are bound by constitutional principles, future legislation is likely to proceed in a manner that ensures the constitutional right to sports. Through such legislation, sports serve as a powerful tool for uniting diverse individuals, fostering social solidarity and integration, and reducing social conflicts. Guaranteeing sports activities as a constitutional right ensures equal opportunities for participation among all citizens. This, in turn, provides important opportunities for personal fulfillment and self-realization, contributing to individuals' mental well-being and happiness. Additionally, by protecting and promoting sports as a constitutional right, it enhances cultural diversity and richness by recognizing sports as a part of culture. Furthermore, from an economic standpoint, the sports industry holds significant economic value, creating job opportunities, attracting tourism, and enhancing a nation's international reputation through successful participation in international sports events. Encouraging sports through constitutional provisions can support these goals. Therefore, by enshrining the right to sports in the constitution, the government can promote citizens' participation in sports and ensure institutional support in terms of policies and finances. Ultimately, this contributes to improving the quality of life for citizens and fostering a healthy and vibrant society.
