교육활동 침해 예방 및 보호 정책의 우선순위

국문 초록

본 연구의 목적은 주요 교육활동 침해 예방 및 보호조치에 관한 정책대안에 관하여 교사와 보호자 집단의 요구를 분석하고, 양자의 공감대가 확인되는 정책대안을 도출함으로써 실제 정책 판단에 시사점을 제공하려는 것이다. 설문조사를 통해 교사와 보호자 인식을 자료로 수집하였으며, 공공선택론 관점에서 점수투표제를 응용하여 6단계 의사결정 단계의 분석을 거쳐 최종적으로 최우선 대안과 차우선 대안이 무엇인지 제시하였다. 최우선 대안으로는 교육활동 침해 학생의 보호자에 대한 조치, 교육활동 침해 학생의 특별교육 또는 심리치료 등, 국가 및 교육청의 교육활동 보호 노력과 홍보가 도출되었다. 아울러 학칙 제정의 정당성 확보와 엄격하고 일관된 학칙 적용, 「아동학대처벌법」 등 다른 법률과의 명확한 관계 설정도 교사와 보호자 간에 어느 정도 공감대가 형성된 차우선 과제라고 할 수 있다. 이외에 교육활동 침해 학생 징계처분이나 예방-치유-재발방지 등 교육활동 보호 one-stop 서비스 제공과 같은 과제는 두 교육주체 간에 이견이 확인되어 추후 면밀한 협의와 검토가 필요하다고 판단된다. 끝으로 본 연구결과를 바탕으로 교원들을 지지하기 위한 국가와 교육청의 홍보 노력, 보호자에 대한 조치 강화, 교육활동 침해 학생의 특별교육 또는 심리치료 관련 실태 파악과 분석, 학교 구성원의 전문적 역량 강화 등이 필요함을 제언하였다.

영문 초록

The purpose of this study is to analyze the demands of teachers and parents regarding policy alternatives for the prevention and protection of major educational activity violations, and to provide implications for relevant policy judgments by revealing policy alternatives that both parties agree on. Teachers and guardians' perceptions were collected as data through a survey, and the score voting system was applied from the point of view of the public choice theory to analyze the six-step decision-making stage. Finally suggested what the top-most and sub-priority alternatives were. As the top priority alternative, there were measures for guardians of students who infringed on educational activities, special education or psychological treatment for students who violated educational activities, etc. In addition, securing the legitimacy of the enactment of school rules, applying strict and consistent school rules, and establishing a clear relationship with other laws such as the 「Act On Special Cases Concerning The Punishment Of Child Abuse Crimes」 can be said to be secondary priorities in which a consensus has been formed between teachers and guardians to some extent. In addition, it is judged that close consultation and review are necessary in the future as differences between the two groups have been identified, such as providing one-stop services to protect educational activities such as disciplinary action for students who violate educational activities or prevention-healing-recurrence prevention. Finally, based on the results of this study, the public relations efforts of the state and education offices to support teachers, strengthening measures for parents, identifying the actual conditions related to special education or psychotherapy for students, and strengthening the professional competence of school members, etc. suggested the need.
