국문 초록

스포츠자치권과 스포츠에 관련된 실정법과의 관계는 각국마다 주어진 상황이 다르기 때문에 일률적으로 정하기는 어렵지만 일정한 기준을 확립하여 구분을 해야 할 필요가 있다. 그렇지 않은 경우, 스포츠의 자치권은 국가의 실정법 틀에 예속하게 되는 문제가 발생할 수도 있다. 물론 스포츠 자체분쟁의 경우 이를 해결하는 것도 스포츠 스스로 해야 한다. 그래서 스포츠 내에서 스포츠분쟁에 대응하여 스포츠중재재판소 내지 스포츠중재심판소 같은 기구가 구성되어 있다. 물론 스포츠분쟁 해결에도 한계가 있다. 예를 들어 스포츠단체나 스포츠선수 간에 상호해결이 안 되는 경우 결국 국가법질서에 의존하게 될 것이다. 그렇지만 국가법으로 해결할 문제는 그 요건이 충족되어야만 한다. 스포츠의 경제적 가치는 스포츠의 사회적 기능과 밀접한 관계를 갖고 있기 때문에 결국 스포츠의 다양한 기능과 가치를 의미하는 것이다. 스포츠의 가치는 스포츠의 중요성을 의미하는 것이기 때문에 국가에 의한 법과 제도적 뒷받침을 통하여 더욱 구체적으로 우리의 생활에 파고 들 수 있다. 더구나 스포츠의 국제화는 국가 실정법에 의한 뒷받침이 필수적이다. 스포츠에 대한 국가의 법정책적 또는 제도적 지원이 없다면 스포츠의 발전을 기대하기란 어렵고 국제화는 더욱 생각하기 어렵다. 이런 이유로 인하여 스포츠의 체계적 발전을 위한 기본법제정문제가 등장한 것이고, 향후 국제적 문제에 있어서도 스포츠기본법은 스포츠의 위상정립과 그 한계를 극복하는 중요한 실정법이 될 것이다.

영문 초록

Sports is inseparably related to individual life and its influence in society gets wider. This trend plays the gut a bigger role. Therefore, it is useless to discuss the necessity of law in terms of sports. Each nation has already supported sports through constitution and law, planned and brought sports policies, as nation s important policy, to effect in order to expand sports industry and facilities. Sports has an international organization and constructs an independent domain. And sports also grants qualifications to players and enacts game rules. The original domain of sports is a unique characteristic which sports has formed for a long time. The rules of sports are not applied to our ordinary lives, but they have direct effect on sports organization and games. the government approves the own autonomous rights of sports domain. Especially sports organization is globalized, and every sort of games are systematized in a pyramid structure. and they act according to their own rules. The relation between positive law related to sports and sports rights of autonomy is difficult to define in a uniform way since every other nations have their own affairs and different situations. But we need to sort them out according to a particular standard. Otherwise, the autonomous rights of sports might be subjected to the influence of positive law. The government can induce great development of sports by admitting and respecting the self right and domain of sports. But, respecting its own domain does not mean that the government should admit all domains of sports without any restrictions. Sports disputes partially require the self settlement of sports and partially need the help of law. Considering this, the relationship between self-autonomy rights of sports and positive law can be settled as sports establishes its domain. Since the value of sports means the importance of sports, legal and institutional support of government is needed. Further, it is necessary that government should support sports by institutional means in order to accelerate globalization of sports. And we recognize now the need of a proper law to resolve various problems in the sports world; lack of life sports activation, limit of an elite sports policy, unbalanced development of unfavored sports, commercialization, and invasions of athletes rights etc. These problems will diminish the constitutional value of sports and may cause social conflicts and contradiction. Without legal policy of government, it is hard to think of development and globalization of sports. Therefore, a basic law is needed for systematic development of sports.
