국문 초록

随着我国体育运动向商业化发展，各种各样的体育纠纷越来越多。如何及时、合理地解决体育纠纷，最大程度地维护争端当事人的合法利益，成为广大体育运动参与者以及体育运动事项研究者关注的问题之一。由于我国现处于经济发展转型阶段，现有的机制却无法满足解决层出不穷的体育纠纷的需要。为了净化体育环境，迫切要求用法制化手段来解决体育运动中争端问题。作者将试图借鉴国际流行的ADR机制和欧美以及一些发达国家在体育纠纷解决上一些成功经验加以比较，并找出适合我国体育纠纷解决方法，为完善中国体育纠纷解决机制，提供理论上参考。本文将从体育纠纷界定、ADR机制、外国体育纠纷解决机制比较、我国体育纠纷解决现状以及我国体育纠纷解决机制设想等方面进行论述。

영문 초록

Along with the commercial developing of the athletics sports in our country, multifarious disputes in athletics becomes more and more. How to resolve the disputes in sports in time and in reason, and how to protect the rights of parties in the dispute furthest, have become the focus of the vast athletics participants and scholars. As our country is now at the turn point of economic development, the mechanism we have can’t reach the endless demand in athletics disputes. For the sake of purify athletics environment, there is an urgent need to use legal method to resolve the problems in athletics disputes. The author is trying to use the international popular ADR system and the experience of some occident developed countries for reference, comparing them and looking for a proper way for our country, so as to offer some theoretical reference to consummate China athletics dispute system. The text follows will do compares in the athletics dispute defining, the ADR system, and the resolve system of athletics dispute in other countries. It also dissertates the actuality of athletics dispute resolving in our country and its system, and some suggestions to it.
