영화 분야 시나리오 표준계약서에 관한 연구

국문 초록

영화산업의 규모가 증가하고 있음에도, 영화진흥위원회가 발표한 ‘시나리오작가 집필환경 실태조사’에 따르면 대다수의 시나리오 작가는 집필료의 미지급, 기한없는 집필작업, 크레딧 누락, 저작권 침해 등 불공정 계약 강요를 경험한 바 있다. 또한 현실의 열악한 작업환경은 창작자로서의 자긍심을 손상시키고 시나리오 작가의 영화계에서 타 분야로의 이탈을 초래한다. 따라서 시나리오작가의 처우 및 집필환경을 개선하기 위하여 공정하고 명확한 계약기준의 마련과 저작권 보호가필요함에 따라 문화체육관광부는 영화 분야의 시나리오 표준계약서를 마련하였다. 시나리오 표준계약서는 “표준 영화화 권리 이용허락 계약서”, “표준 영화화 권리 양도 계약서”, “표준 각본 계약서”, “표준 각색 계약서”의 4가지 유형으로 나뉘어 있다. 주요 내용은 계약서별로용어의 정의, 집필의 대가, 권리 귀속, 계약 중단시 조치, 크레딧의 명시, 분쟁 해결 등으로 이루어져 있다. 저작권 처리 문제 등에 있어서 제작사의 입장에서는 시나리오 표준계약서 사용을 꺼릴 우려가있으나, 작가에게는 창작자로서의 권리를 지키기 위하여 집필계약 체결시 내용을 명확히 인지하고시나리오 표준계약서 사용을 위해 노력할 것이 요구된다. 다만, 시나리오 표준계약서의 사용을 직접적으로 강제할 수 없다는 점에서 정부의 정책 수립과지원이 요구될 뿐만 아니라 계약 당사자인 제작자와 작가의 시나리오 표준계약서에 대한 이해와사용의지가 필요하다.

영문 초록

Even though the size of film industry is increasing, according to ‘a survey on the work environment of screenwriters’ announced by Korean Film Council, the majority of screenwriters had experienced the imposition of unfair contracts such as unpaid payment for writing, termless writing, missing credits, and copyright infringement. Also, the reality of poor working conditions damages pride as a creator and results in the change of field from the film industry. Therefore, Ministry of Culture, Sports and Tourism provided a standard contract for screenwriters in the field of films in order to establish fair and clear standards and copyright protection. The standard contract for screenwriters consists of four categories: usage permission to film, transfer of a right, scripts and adaptation. The main contents are the definitions of terms, payment for writing, copyrights, actions in suspension of contract, credit, conflict resolution, etc. Producers might avoid using the standard contract for screenwriters due to copyright problems, but to protect the rights as creators, writers are demanded to clearly recognize the contents when a contract is signed and use the standard contract. However, we cannot compel the film producers to adopt the standard contract for screenwriters. So, the policy establishment and support of government is required, and it is necessary for producers and writers to have the understanding and willingness about the standard contract.
