스포츠베팅 산업의 법제도 개선 방안

국문 초록

본 연구는 스포츠베팅 산업의 현황과 문제점을 검토한 후, 스포츠베팅 산업의 법제도를 진흥 목적으로 개선하는 방안을 제시하였다. 검토 결과, 스포츠베팅 산업의 현행 법제도는 ①스포츠 서비스업에 해당함에도 불구하고 정책의 목표가 불명확하고, ②스포츠산업에 해당하는 경륜, 경정과 경마를 제외하는 등 스포츠베팅 산업을 임의적으로 포섭하고 있어 산업의 범위가 불분명하며, ③사행성에 대한 기준이 없이 일률적이고 전방위적인 규제가 가해지고 있어 경쟁력이 미약하였다. 이에 본 연구는 ①체육진흥투표권 사업의 근거 법률을 스포츠산업법으로 개정하고 사업 명칭을 체육복권으로 변경하여 스포츠베팅 산업으로의 진흥과 사업 건전성 확보의 교두보를 마련함과 동시에 정책의 목표를 분명히 하고, ②경마와 경륜, 경정의 근거 법률을 스포츠산업법에 포섭하여 스포츠베팅 산업의 범위를 명확하게 하는 한편, 한국마사회를 말산업의 총괄 기관으로 변모하게 하여 도심형 레저산업을 선도하게 하고, ③스포츠베팅 상품에 대한 주무부처의 사전 승인 권한을 사후 관리·제한 권한으로 변경하고, 온라인베팅제를 도입하여 불법도박에 맞서는 것과 동시에 이용자의 이용행태를 철저하게 관리하며, 매출총량제를 재검토하여 실효성 없는 규제를 개선하는 방안을 제시하였다. 본 연구 이후에도 스포츠베팅 산업의 목적과 진흥 방안에 대한 연구가 계속되어, 개별 사업 위주로 난립한 현행 베팅 산업의 법률 체계가 개선되고 국가가 관리하는 스포츠베팅 산업이 불법 스포츠도박 보다 경쟁 우위를 차지하여, 스포츠 진흥과 문화대국으로의 발돋움에 중핵이 될 것을 기대할 수 있었다.

영문 초록

This study reviewed the current status and problems of the Sports Betting Industry in Korea and presented measures to improve the legal system for the Industry. As a result of the review, the current legal system of Sports Betting Industry was unclear on the goals of the policy, even though it corresponds to the Sports Service Industry. Secondly, the scope of the Industry was uncertain as it arbitrarily embraces the Sports Betting Industry, excluding Horse Racing, Bicycle Racing and Motorboat Racing. Lastly, uniform regulations were imposed without the standard for Speculation, making it less competitive. In this regard, this study proposed a measure to clarify the goals of policies while providing a bridgehead for promoting the Sports Betting Industry and securing the soundness of the business by changing the fundamental law. In addition, the Sports Industry Act had to include Horse Racing, etc, and the Korean Racing Authority had to lead the Urban Leisure Industry by turning into a general and powerful organization of the Horse Industry. Lastly, this study proposed introduction of Online Betting for Sports Betting and abolition of total sales cap of Gambling Industry. After this study, if research for promoting Sports Betting Industry continue so that the legal system, which is scattered on each laws will be integrated. So that the Sports Betting Industry will get competitiveness edge over Illegal Sports Betting, which can be a key to promoting Sports Industry and make Korea stronger leisure culture country.
