승인받지 않은 대회 참가 선수에 대한 스포츠단체의 제재와 경쟁법의 적용

국문 초록

스포츠계에서는 각 종목마다 국제단체가 하나밖에 없고 경기를 하고 싶은 선수는 해당 단체가 정한 규칙을 따라야만 한다. 이 국제스포츠단체의 독점적 지위는 소속 선수들에 대한 배타적 행위, 신규 진입 사업자에 대한 경쟁제한행위를 일으키기 쉬운 환경을 만들기 때문에, 스포츠가 가진 특성에도 불구하고 경쟁법의 적용이 문제될 소지가 있었다. 그런데 최근 승인하지 않은 대회에 참가하는 선수에 대해 과도한 징계를 하는 국제스포츠단체의 규정을 경쟁법에 위반되는 행위로 판단한 유럽연합 집행위원회의 결정이 나와 주목되고 있다. 아이스더비에 참가하고자 하는 선수를 징계하는 국제빙상연맹의 자격규칙이 선수의 경제적 자유를 제한하는 한편 잠재적 경쟁자가 국제스케이트 대회의 조직 및 시장에 진입하는 것을 방해한다고 판단한 것이다. 유럽연합 집행위원회는 스포츠단체의 규정이 정당한 목적을 추구하기 위한 고유한 것으로서 목적과 수단의 균형을 잃지 않으면 경쟁법의 적용을 받지 않지만, 국제빙상연맹의 자격규칙은 이를 위반한다고 보았다. 국제빙상연맹은 스포츠의 진실성, 선수의 건강･안전 보호 및 도핑방지, 스포츠 경기의 조직 및 적절한 운영 등을 위해 자격규칙이 정당하다고 주장하였지만 받아들여지지 않았다. 오히려 이런 규정은 아이스더비가 계획한 대회의 개최를 막기 위해 사용되었기 때문에 경쟁법에 위반된다고 보았다. 각 경기의 스포츠단체마다 이러한 자격규칙을 두고 있는 경우가 많기 때문에, 이번 유럽연합 집행위원회의 결정은 향후 국내외적으로 중요한 영향을 줄 것으로 생각된다.

영문 초록

In the sports industry, each game only has a single international federation and an athlete willing to play must follow the rules designated by them. This monopolistic status of the International Sports Federation leads to being exclusive toward the athletes and building an environment easier to implement anti-competitive practices to other businessmen. Therefore, it was possible that the application of competition law cause problems, even when considering the characteristics of sports. Thus, it is noticeable that the European Commision recently judged a regulation as illegal to the competition law, when the international sports federation took further than necessary disciplines to athletes participating in disapproved competitions. That is, the International Skating Union’s (ISU) Eligibility rules which disciplines athletes willing to participate in Icederby was considered as restricting the individual’s financial freedom and hindering a potential competitor from entering the organization of international skating events. The European Commission states that regulations which pursue justifiable goals and do not lose the balance of purpose and means are admittable to the competition law, which does not correspond to the ISU’s Eligibility rules. ISU claimed that the regulation was proper due to the integrity of the sport, protection of health and safety and anti-doping, and the organization and proper conduct of competitive sport, which was not accepted by the European Commission. Rather, this regulation was considered as having been used to hinder the hold of an event planned by Icederby. For all sports group have their own eligibility rules, this resolution by the European Commission is expected to give great influence in both internal and external perspectives.
