국문 초록

<토끼의 재판> 설화는 주제나 구조적으로 상당히 정형화되어 있는 작품이지만, 각 편들에 나타난 변이의 양상을 심층적으로 들여다보면, 음미할 만한 내용들이 무척 풍부한 작품이다. 보기 드물게 구술문화의 논쟁적 성격에 바탕을 두고 있어서 다성성의 차원에서 작품을 꼼꼼히 살펴볼 필요가 있는데, 한국과 중국의 <토끼의 재판> 설화를 비교함으로써 심층적인 논의가 가능했다. 구조 장면, 다툼 장면, 재판 장면으로 구성되어 있는 <토끼의 재판> 설화는 목숨을 담보로 한 논쟁이 펼쳐지고, 그것을 제3자에게 재판을 요청하여 해결하려 한다는 점에서 무척 논쟁적인 작품이다. 구술문화적 논쟁의 극한성, 논쟁적인 재판의 당파성, 구술문화적 객관성인 불편부당성 등이 잘 형상화되어 있는 전형적인 작품이면서, 아리스토텔레스가 이야기한 수사학적 설득의 세 가지 방법을 충실히 담아내고 있는, 구술문화적 논쟁과 관련된 교과서적인 작품이다. 또한 이렇게 논쟁성이 극대화되는 지점에서 구술문화의 또 다른 특징인 다성성이 강렬하게 발현되는 작품이기도 하다. 재판을 중심으로 하는 논쟁적인 작품답게 등장인물들의 목소리가 전체와 어우러지면서도 독자적인 울림을 보여주는 작품이다. 한·중 <토끼의 재판> 설화는 기본적으로 호랑이의 배은망덕을 비판하는 내용을 담고 있지만, 이것을 구술문화적 논쟁을 통해 드러내는 과정에서 서로 다른 지향을 보여준다. 중국의 경우는 사악한 호랑이에 대한 비판과 더불어 그러한 호랑이에게 여지를 준 사람의 안일한 생각을 진지하게 비판하고 있다면, 한국의 경우는 오히려 곤란한 상황에 처한 사람을 구해준 훌륭한 판결을 내린 토끼의 현명함에 더 주목하면서, 서사적 굴절과 반전의 묘미를 소화적으로 즐기려는 경향이 강하다. 중국이 철학적 지향으로 갔다면 한국은 서사적 지향으로 갔고, 중국이 주제적이라면 한국은 다분히 소화적이다.

영문 초록

The Rabbit s Trial folktales is a work that is generally stereotyped in terms of theme and structure; however, a deeper inspection of the variations within each version reveals a body of work that is remarkably rich in content. Given that it is based on the controversial nature of oral culture, it is necessary to carefully examine the work in terms of its polyphonicity, making an in-depth discussion possible by comparing the Korean and Chinese forms of the Rabbit s Trial folktales. The Rabbit s Trial, which is composed of three scenes – namely, a rescue scene, a quarrel scene, and a trial scene – is considered to be very controversial given that a debate takes place regarding the basis of life, which is resolved by asking a third party for a trial. It is a typical work that is well-embodied in the extremes of oral cultural debate, partisanship of controversial trials, and in regard to the impartiality of oral cultural objectivity. It is a standard work related to oral cultural debates which faithfully contains the three methods of rhetorical persuasion (as outlined by Aristotle). It is also a work in which polyphony, another characteristic of oral culture, is expressed intensely. As a controversial work centered upon trials, the voices of the characters harmonize with the whole, yet show an independent resonance. The folktales of Rabbit s Trial in Korea and China commonly contain content that criticizes the ungratefulness of tigers; however, they utilize differing processes in revealing this via oral cultural debates. In the case of China, they criticize evil tigers and severely criticize the comforting thoughts of those who gave room to them. In the case of Korea, rather, the narrative tradition pays more attention to the wisdom of the rabbit, who’s good judgment helped save a person in trouble. In Korea, there is a strong tendency to enjoy narrative funs and reversals with laughter. While Chinese works demonstrate a philosophical orientation, Korean works present a narrative orientation; while Chinese works are thematic, Korean works are humorous.
