장애학생 인권침해에 대한 국가인권위원회 결정례 분석을 통한 학교 내 인권보호에 관한 연구

국문 초록

본 연구에서는 학교 내 장애학생의 인권침해 내용을 파악하고, 현재 시행되고 있는 제도적인 보호방안의 문제해결과 앞으로의 인권보호의 영역을 확대할 수 있는 개선방안을 제안하고자 하는데 연구의 목적이 있었다. 이를 위해 최근 국가인권위원회 장애인차별시정위원회의 2017년-2018년도 장애학생 인권침해 4개의 진정사례를 분석하였다. 국가인권위원회 사례 분석결과 장애로 인한 입학 거부, 특수교육대상자의 특성을 반영하지 못한 과중한 과제 부과로 정신적 고통을 가한 괴롭힘과 특수교육대상자의 수행평가 배제 등의 수업배제로 인한 차별, 특수학급 설치를 회피함으로써 특수교육대상자의 전학을 사실상 거부하여 장애인이 평등하게 교육받을 수 있는 권리 침해, 공개장소인 교실에서 머리카락 잡아당긴 행위로 심리적·신체적인 괴롭힘을 당했다. 이에 장애학생 인권보호를 위한 세부적인 해결방안을 위해 장애학생 스스로 권리주장을 할 수 있는 개인별맞춤교육기회제공을 위한 인권강화프로그램의 필수성과 통합학급분위기조성을 위한 비 장애학생에게 장애에 대한 바른 이해와 인식개선이 필수적으로 실시되어야 하며, 그러한 가치와 경험을 담을 수 있는 교사와 특수교사의 연합이 필요하다. 이와 함께 장애학생을 위한 전문가와 관계자들의 노력이 진정한 통합교육시스템을 만들 수 있게 된다.

영문 초록

The purpose of this study was to grasp the contents of human rights violations of students with disabilities in schools, and to propose improvement measures that can solve the problems of the current institutional protection measures and expand the scope of human rights protection in the future. To this end, we analyzed four complaints of human rights violations of students with disabilities in 2017-2018 by the National Human Rights Commission of Disability Discrimination Committee. As a result of the National Human Rights Commission s case analysis, discrimination due to class exclusion, special class installation, etc. By avoiding it, he virtually refused the transfer of special education subjects and infringed on the right for the disabled to be educated equally. Therefore, for the solution to protect the human rights of students with disabilities, the essentiality of the human rights enhancement program to provide personalized educational opportunities for students with disabilities to make their own rights, and to improve the understanding and awareness of disabilities to non-disabled students to create an integrated class atmosphere. This must be done, and a union of teachers and special teachers is needed to contain those values and experiences. At the same time, the efforts of experts and officials for students with disabilities can create a truly integrated education system.
