국문 초록

가정폭력과 아동학대에 대한 사회적 관심은 여성운동과 아동복지라는 서로 다른 이슈에서 출발하였고, 그에 따라 지금까지도 독립된 문제접근 방식과 전달체계를 취하고 있다. 그렇기 때문에 아동의 가정 폭력 목격은 가정폭력이자 아동학대라고 볼 수 있음에도 불구하고 ‘피해’로 인식되지 않았다. 따라서, 지금까지 국내 연구들이 가정폭력을 목격한 아동의 피해에 대해 단지 피해아동의 공격성이나 비행으로 주목해 왔다면, 본 연구에서는 가정폭력 목격 아동을 피해자로 개념 정립하고자 함에 목적이 있다. 이를 위해 우리나라 가정폭력과 아동학대의 정의와 보호체계를 검토하였고, 일찍이부터 가정폭력과 아동학대의 중복발생에 주목한 국외의 연구 동향을 고찰하였다. 또한, 미국의 주법을 중심으로 아동의 가정폭력 목격과 관련한 입법을 고찰함으로써, 피해자 개념에 대한 철학과 합의의 구축, 입법의 변화, 피해자 보호시스템의 협력과 통합 등을 제언하였다.

영문 초록

The social concerns in domestic violence and child abuse originated from the different issues of women s movement and child welfare. As a result, they still have separate approach and delivery system. For these reasons, witnessing domestic violence of children has not been perceived as damage , even though it could be considered domestic violence and child abuse. Thus, although domestic studies have been considering the damages of children who have witnessed domestic violence as aggression or misconduct the children, this study aims to establish the concept of children who have witnessed domestic violence as victims. To this end, this study examined the definition and protection system of domestic violence and child abuse in Korea, and examined the trends of foreign research that focused on the co-occurrence of domestic violence and child abuse. In addition, this study suggested the establishment of a philosophy and consensus on the concept of victims, changes in legislation, and cooperation and integration of victim protection systems, based on a review of US state statutes regarding witnessing domestic violence of children.
