사회복지사 자격 제도에 내재된 차별의 사례와 개선 방안

국문 초록

법적 규정없이 활동하는 사회복지사는 1970년에 처음으로 법정 자격으로 인정받았다. 1989년에는 사회복지사 1급 시험이 도입되었으며, 2019년에는 전문자격증 시대가 도래하였다. 그러나 사회복지사업법 및 시행령 중 사회복지사 자격 취득과 관련된 차별적 법령들이 포함되어 있었으며 오랫동안 개선되지 않았다. 이 중 사회복지사 1급 자격시험의 전문대 졸업자에 대한 차별은 2013년도에, 정신장애인의 사회복지사 자격 취득에 대한 차별의 문제는 2018년도에 국가인권위원회에 당사자로부터 제소되었다. 그 결과 국가인권위원회에서는 두 사안 모두 인권침해가 명백한 것으로 결론을 냈으며, 해당 조항의 폐기 또는 개정을 보건복지부에 요구하였다. 그러나 6년이 지난 지금도 1급 자격시험의 전문대 졸업자에 대한 차별 규정은 여전히 유효하며, 정신장애인과 관련된 차별은 모든 부처가 참여하여 논의하기는 하지만 진행정도가 느리기 때문에 폐·개정에는 오랜 시간이 소요될 것으로 보인다. 따라서 사회복지사 스스로 자신들을 위한 인권 의식을 고양하고, 사회복지사업법 및 시행령에 내재된 차별 규정들을 삭제하기 위한 노력을 기울여야 한다. 또한 대학교육과정에서도 사회복지사의 인권을 보호하고 향상시킬 수 있는 내용도 포함하여야 한다. 특히, 한국사회복지사협회를 중심으로 인권 차별의 개선을 위한 정치적, 사회적 행동을 지속적으로 해야 한다.

영문 초록

Social workers working without legal provisions were first recognized as statutory in 1970. In 1989, the first class of social worker examinations were introduced. In 2019, the era of professional qualifications arrived. However, the Social Welfare Services Act and Enforcement Decree included discriminatory laws related to the acquisition of social worker lisence. In 2013, there was a complaint by the National Human Rights Commission of discrimination against the first-class qualification test for social workers. In 2018, the issue of discrimination against the acquisition of social worker status for the mentally disabled was filed. The NHRC of Korea concluded that human rights violations are evident in both cases. However, six years later, discrimination provisions still remain in place for college graduates in the first-level qualification exams. Reformation of discrimination related to mentally disabled people is very slow, with the participation of all ministries. But, it will take a long time to close and revise the relevant law. Therefore, social workers should raise their awareness of human rights for themselves. Efforts should be made to eliminate discrimination provisions inherent in the Social Work Act and the Enforcement Decree. The curriculum should also include content that protects and enhances the human rights of social workers. In particular, the Korea Social Workers Association should continue to engage in political and social actions to improve human rights discrimination.
