국문 초록

시장형 노인일자리사업이 시행된 지 14년 가까이 되고, 2015년에 수행된 시장형사업단이 총 1,023개, 누적참여자 22,907명 넘어서는 등 양적 팽창이 이루어진 상태에서 이제는 시장형 노인일자리사업이 참여노인의 근로권을 어느 정도 보장하고 있는지에 대한 질적 수준에 대한 접근이 필요하다. 이러한 필요성에도 불구하고 지금껏 시장형 노인일자리사업에 대한 논의는 소득, 건강, 사회적 관계, 심리 등 개인에게 나타나는 다양한 측면의 긍정적 효과들을 밝히는 연구가 진행되었을 뿐, 참여자의 근로권이 어느 정도 보장되고 있는지에 관한 연구는 전무한 상황이다. 이에 본 연구에서는 시장형 노인일자리사업의 근로권 보장성에 대한 탐색적 논의를 시도한다. 이를 위해 우선 헌법이 보장하는 근로권의 내용을 파악하고 권리 구성요소를 살펴본 후, 참여자들과의 인터뷰 자료를 활용하여 시장형 노인일자리사업의 근로권 보장성을 분석하였다. 연구참여자들의 면담자료를 ‘시장형 노인일자리사업의 근로권 보장성’이라는 주제로 축코딩한 결과, 모두 7개의 하위 범주를 산출할 수 있었고, 이러한 7개의 범주는 다시 2개의 상위범주로 묶였다. 연구참여자들의 면담자료에 드러난 ‘시장형 노인일자리사업의 근로권 보장성’ 주제는 ‘근무형태의 특성’과 ‘임금의 적정성’이었다. ‘근무형태의 특성’의 하위범주는 ‘상시적 vs 한시적’, ‘매일제 vs 격일제’, ‘전일제 vs 시간제’, ‘고정적인 근무시간 vs 유동적인 근무시간’의 4가지로 나타났다. ‘임금의 적정성’의 하위범주로는 ‘적정임금형’, ‘비적정임금형’, ‘최저임금위배형’이 도출되었다. 이러한 연구결과를 바탕으로 참여노인의 근로권 보장성 강화를 위한 정책적·실천적 제언을 하였다.

영문 초록

It has been nearly 14 years since Business Start-up Program for the Elderly came into operation. A Market-type Enterprise Organization, which performed in 2015, went through its quantitative expansions as it recorded to provide 1,023 employment opportunities and have accumulated participants more than 22,907. The following step to take at this stage is to embrace an approach in terms of qualitative standards of the program the extent which Business Start-up Program for the Elderly guarantees a right-to-work for those senior participants. Although there is a substantial necessity to take an approach of qualitative standards towards Business Start-up Program for the Elderly, there have been merely studies about several positive effects to individuals in a variety of aspects such as wages, health, social relationships, and psychology, etc. so far. Besides, the research to discuss the extent to which those participants’ rights-to-work are guaranteed is non-existent. In this research, therefore, it will discuss about the issue of a right-to-work guarantee of Business Start-up Program for the Elderly as an explorative approach. In this research, it firstly figured out the contents of a right-to-work, which are guaranteed under the constitution, examined components of a right-to-work, and then analyzed about the issue of a right-to-work guarantee of Business Start-up Program for the Elderly, while the research is using survey data of 14 participants from the interview materials. After the research had been conducted and the interview materials had been sorted out under the theme of a right-to work guarantee of Business Start-up Program for the Elderly, there were 7 categories for the results in total. These 7 categories under the main theme, again, were clustered in 2 themes. The themes for a right-to-work guarantee of Business Start-up Program for the Elderly, which were covered in the interviews of the participants, include ‘The Characteristics of Work Patterns’ and ‘The Issue of Fair Wages’. The categories for the ‘Characteristics of Work Patterns’ appeared to have 4 underlying themes with ‘Ordinary vs Temporary’, ‘Working Everyday vs Working Every Other Day’, ‘Full-time vs Part-time’, and ‘Fixed Working Hours vs Flexible Working Hours’. The categories for the ‘Issue of Fair Wages’ resulted in 3 underlying themes with ‘Type of Fair Wages’, ‘Type of Unfair Wages’, and ‘Type of Being Against To The Minimum Wage’. Based on the findings of this research, it proposed some ideas about appropriate and reasonable policies to reinforce a right-to-work guarantee of the senior participants in the program and some supporting ways to implement these policies in practice.
