아동학대범죄 판결의 양형 인자에 대한 연구

국문 초록

아동학대범죄 양형에 대한 비판은 거세다. 다른 범죄에 비해 경미한 처벌을 받거나 사건마다 양형의 차이가 크기 때문이다. 이는 응보를 목적으로 하는 전통적인 양형관과 아동학대범죄의 특수성 간 발생하는 상충에서 비롯된 것으로 볼 수 있다. 따라서 본 연구에서는 아동학대범죄의 양형기준이 아동학대범죄의 특수성을 반영하고, ‘가해자’를 위한 양형이 아닌 ‘피해아동’을 위한 양형으로 변화하며, 양형 판단 기준이 ‘처벌’이 아닌 ‘회복’이 되어야 한다는 방향성을 설정하고 아동학대범죄 판결문 양형의 이유를 분석하였다. 분석 결과, 피해아동보다는 가해자 측면에서 양형을 고려하고 있는 경우가 많았다. 즉 반성과 같은 양형 인자는 가해자의 감형을 고려하는 등 면죄부가 목적이 될 뿐이어서, 재학대 방지를 위해 진정성을 고려하는 경우는 소수였다. 피해자 중심 양형 중 가장 주요하게 고려되고 있는 것은 피해아동의 의사이나, 가해자의 가족이기도 한 가족이 아동을 대변하는 경우가 많았고 아동최우선의 이익에 대한 고민은 찾아보기 어려웠다. 행위 중심 양형 인자 중에서는 범행 경위가 가장 주요하게 고려되고 있는데, 우발성을 감형 요소로 보고 훈육을 아동학대의 동기로 인정하기도 하였다. 이와 같은 연구결과를 토대로 아동학대범죄 양형 요소와 기준에 대한 깊은 숙고를 통해 일반 폭력 범죄와 다른 차별성을 두는 양형 기준 패러다임의 변화, 재학대 가능성에 대한 민감성 함양, 아동이 입은 피해에 주목하기 등을 제언하였다.

영문 초록

Criticism of legal sentences on child abuse crimes has been very strong. It is either because punishments for these offenses have been light in comparison with those for other crimes or because sentences have differed considerably by case. This can be seen as stemming from the conflict between the traditional view of sentences, whose purpose is retribution, and the special nature of child abuse crimes. Consequently, the present study analyzed the reasons for sentences in judgements on child abuse crimes after establishing the direction that the standard for sentencing child abuse criminals must reflect the special nature of child abuse crimes, sentences must change to focus on the victimized children rather than on the victimizers, and the standard for determining sentences must be restoration instead of punishment. According to the results of the analysis, sentences were considered in terms of the abusers than of the abused children in many cases. In other words, sentencing factors including remorse only served as occasions for considering the mitigation of the victimizers’ sentences, and the genuineness of the victimizers’ sentiments was taken into consideration for the prevention of the recurrence of abuse only in a small number of cases. While the wishes of the abused children constituted the aspect taken into consideration most importantly in victim-centered sentences, these children were represented by family members who also happened to be related to the victimizers in many cases, and difficult to find were considerations of the best interests of children themselves. Out of behavior-centered sentencing factors, the greatest weight was placed on the circumstances of criminal acts, inadvertence was seen as a mitigating factor, and discipline was acknowledged as a motive for child abuse as well. Based on these results of the research and through deep reflections on the elements and standards of sentences on child abuse crimes, the present study proposed changes in the sentencing standard paradigm that would distinguish between child abuse crimes and general violent crimes, cultivation of sensitivity to the possibility of repeated abuse, and attention to the damages suffered by children.
