전문사회복지사 자격제도 법제화의 동향과 과제

국문 초록

정부는 2007년 전문사회복지사 자격제도 도입의 필요성에 공감하여 전문사회복지사 자격제도를 도입하는 내용을 포함한 사회복지사업법 일부개정법률안을 국회에 제출하였다. 전문사회복지사 자격제도를 요구하는 최초의 법안으로 볼 수 있는 본 법안은 제17대 국회의 임기만료로 폐기되었다. 이후 10년이 지난 금년 상반기에 오제세 의원 등과 양승조 의원 등이 다시 전문사회복지사 자격제도 도입 내용이 포함된 사회복지사업법 일부개정법률안을 발의하였다. 결국 이 법안들도 추가적인 의견수렴을 진행 후 결정하는 것이 좋겠다는 국회 보건복지위원회 법안심사소위원회의 회의결과에 따라 개정 법률에는 포함되지 못했지만, 영역별로 특화된 사회복지서비스 제공의 사회적 요구에 부합하는 전문사회복지사 자격제도의 필요성을 보여주었다는데 의미가 크다고 하겠다. 이에 본 연구는 전문사회복지사 자격제도의 법제화를 위한 그 동안의 추진과정 및 현황을 살펴보고, 필요성이 인정된 전문사회복지사 자격제도를 법제화하기 위한 향후 사회복지계의 과제를 제시하였다. 우선, 전문사회복지사 자격제도의 추진 동향을 살펴봄에 있어, 전문사회복지사 자격제도 법제화 추진과정, 전문사회복지사 자격제도 도입을 위한 사회복지계의 노력, 사회복지영역별 전문사회복지사 활동의 법적 근거와 현황, 타 휴먼서비스 전문자격제도의 현황, 외국의 전문사회복지사 자격제도의 현황을 검토하였으며, 검토된 내용을 바탕으로 전문사회복지사 자격제도 법제화와 관련된 쟁점을 논의하였다. 마지막으로, 쟁점 논의를 바탕으로 향후 사회복지계가 전문사회복지사 자격제도를 법제화하기 위해 고민하고 해결해야 할 과제들을 제시하였다. 전문사복지사 자격제도를 법제화하기 위한 향후 과제는 다음과 같다. 첫째, 전문사회복지사 자격제도의 필요성에 대한 사회복지계 내외부의 공감대를 확대해야 한다. 둘째, 전문사회복지사 자격제도 법제화 방향 및 내용에 대한 사회복지영역 간의 합의를 도출해야 한다. 셋째, 전문사회복지사 자격제도가 사회복지 현장에서 실제 활용될 수 있도록 구체적 제도 실행방안을 구축해야 한다. 넷째, 전문사회복지사의 활동영역 및 일자리 확대를 위한 노력을 병행해야 한다. 마지막으로 전문사회복지사 자격제도 법제화를 위해 체계적으로 입법 활동을 추진해야 한다.

영문 초록

The government, in recognition of the need for specialty social worker licensure, submitted the revised bill on the Social Welfare Services Act including the introduction of the licensure to the National Assembly in 2007. This bill, the first one requiring specialty social worker licensure, was abolished due to the expiration of the 17th National Assembly. In the first half of this year, 10 years since the first attempt of legislation, the revised bills on the Social Welfare Services Act were submitted to the National Assembly again, including the introduction of the specialty social worker licensure. After all, this attempt was not actualized again this time but it was meaningful to clarify the social needs for specialized social welfare services and the necessity of the licensure. The purpose of this study is to review the processes of legislation efforts for specialty social worker licensure, and to explore future strategies for its legislation. First, in examining the trends of specialty social worker licensure, we reviewed the attempts of legalization of the licensure, the efforts of the social welfare academia and fields for introducing the licensure, the legal basis and status of specialty social worker s duties, cases of specialty licensure of other human service professions, and cases of specialty social worker licensure of other countries. Then, we discussed the issues related to specialty social worker licensure based on the reviewed contents. Finally, through the above review and discussion, we made five suggestions for future legislation of the specialty licensure. Our suggestions are as follows. First, it is required to expand the consensus within and outside the social welfare system about the necessity of specialty social worker licensure. Second, it is necessary to draw the agreement among social welfare areas regarding the direction and contents of the specialty social worker licensure. Third, the specific implementation plans should be constructed so that specialty social worker licensure can be practically applied and used in fields. Fourth, efforts should be made to expand the working areas and jobs of social workers. Finally, legislative activities should be pursued systematically.
