국문 초록

본 연구의 목적은 실체를 확인할 수 없는 가상소득인 부양비로 인하여 수급권자의 급여를 삭감하고, 부양비가 지급될 것이라는 불확실한 가정(假定)에 의해 헌법상 보장된 사회보장수급권을 침해하는 부양능력미약제도의 본질적 문제점을 분석하고 수급권 보장에 친화적인 개선방안을 강구하는 것에 있다. 분석결과, 미약제도 운용상의 문제를 유발하는 근본적인 요인은 법적근거 조항인 시행령 제5조의6 제1항 제4호 다목의 모호한 법문에 있음을 확인하였다. 일정수준의 명확성을 확보하지 못한 시행령 규정은 내적결함으로써, 다의적인 해석을 유발하고 필수 충족요건인 ‘부양비 지급’을 단순 전제 내지는 권고사항으로 인식되도록 한다. 이어 부양비 지급여부를 공식적으로 파악할 수 있는 확인절차가 없다는 문제점을 확인하였다. 또한 민법상 사적부양의무 관계의 특성 및 차이, 부양정도를 숙고하지 않고 지나치게 높게 책정된 부양비 수준 역시 문제가 됨을 알 수 있었다.

영문 초록

The purpose of this study is to analyze the fundamental problem of system of marginal ability to support which invades the rights to social security ensured by constitution under uncertain assumption that the virtual sustenance cost will cut the wage of beneficiary and provide the payment, and to seek for friendly improvement measure for benefit guarantee. As for the analysis result, the fundamental element causing the problem in enforcing the system was due to ambiguous regulation specified in Verse C(Da), Item 4, Paragraph 1 of Article 5.6 of enforcement ordinance. Ordinance without certain clarity has internal deficiency, which cause polysemous interpretation, and make maintenance payment , the requirement, recognized as simple premise or subject of recommendation. Next, there was no confirmation procedure to formally apprehend the payment. Also, sustenance cost that is excessively high without considering the support condition pauses problem. Therefore, this study prepared a system improvement measure to overcome reviewed problems. First, the study proposed revised version of Verse C(Da), the unclear ordinance regulation as legal foundation. Specifically, the study elaborated vague description of Verse C and cleared administrative foundation which reflects sustenance cost as income. Second, the study established new regulation for sustenance cost payment, and specifically proposed confirmation and follow-up process after the payment. Third, the study proposed a downward regulation of sustenance cost payment to increase the possibility of sustenance cost support and to accord with private support liability relationship.
