국문 초록

금융거래정보요구권은 공공기관 등이 소관업무의 수행을 위하여 금융회사에 거래정보등을 요구하는 권한을 말한다. 다만, 검찰 등 수사기관은 법관이 발부한 영장이 있어야만 금융회사로부터 금융거래정보를 취득할 수 있다. 주요국의 사례를 살펴보면 행정기관은 영장없이 금융거래정보를 취득하고 있다는 점은 한국과 유사하나, 수사기관의 경우 한국과 같은 영장주의를 강제하지 않는다는 차이점이 있다. 금융거래정보는 계좌번호 뿐 아니라 성명, 주민등록번호 등이 포함되고, 거래정보를 통해 개인의 소비성향, 거래장소 등 사회생활 패턴을 파악할 수 있다는 점을 고려하면 보호해야할 개인정보로 보는데 문제가 없을 것으로 생각된다. 다만, 금융거래정보요구권의 운영은 국민의 기본권 보호와 공익 추구간 균형을 유지하여 운영하는 것이 필요하다. 보완책으로는 공공기관이 취득한 금융거래정보의 파기 등 관리체계를「개인정보보호법」과 같은 수준으로 관리하도록 하여 정보의 오용·유출로 인한 피해가 없도록 할 필요가 있다. 수사기관의 영장주의 원칙과 관련하여 공공기관이 법률에 따라 고발·통보한 사건과 관련한 금융거래정보의 인계에 대해서는 영장주의의 예외를 인정할 필요가 있고, 공공기관이 통보한 사건에 한하여 포괄영장을 허용함으로써 수사의 효율성을 제고하는 것이 바람직하다.

영문 초록

The right to request financial transaction information is the right to require financial transaction information from financial institutions for the performance of their business by public institutions. According to the cases of other countries, not only administrative agencies but also investigative agencies do not need warrants for financial transaction information demands. Given that financial information includes account numbers, names and resident registration numbers, it constitutes personal information that needs protection. However, it is necessary to maintain a balance between the protection of basic rights of the people and the pursuit of public interest in the operation of financial transaction information requirements. It is necessary to operate the management of financial transaction information acquired by public institutions at the same level as the Personal Information Protection Act. Exceptions to warrant requirements should be granted for cases where a public authority has filed a complaint or notice in accordance with the law. Where certain requirements are met, a comprehensive warrant shall be granted to contribute to the efficiency of the investigation.
