교육부와 시·도 교육청 간의 정책 갈등에 대한 패러독스 분석

국문 초록

본 연구는 ‘자율형 사립고등학교(이하 자사고)’ 정책을 둘러싼 ‘교육부’와 ‘서울시교육청’ 사이의 갈등을 정책 패러독스 관점에서 분석하였다. 교육부는 국가 사무인 ‘교육’을 ‘관리, 감독’해야 하고, 주민직선제 하에서 교육감은 위임사무를 수행해야 하지만 이와 동시에 ‘표’를 획득하기 위해 ‘정치적 행위’를 할 수밖에 없기때문에 갈등이 필연적으로 나타날 수밖에 없다. 자사고 재지정 취소를 둘러싼 교육부와 서울시교육청의 갈등은 표면적으로는 중앙과 지방의 갈등으로 보인다. 하지만, 정책패러독스 관점으로 접근하면, ‘자유’와 ‘형평’이라는 정책 목표와 ‘학교선택권’과 ‘고교평준화’라는 정책 수단의 갈등이며, 정책 수혜자의 이해관계 충돌이라는 측면에서 ‘서울시교육청과 학부모 및 자사고’의 갈등을 내포하고 있다고 볼 수 있다. 뿐만 아니라, 교육정책의 일관성 측면에서 본다면, ‘서울시교육청과 타 시·도 교육청’의 갈등 혹은 서울시교육청 내부의 교육정책 일관성 충돌에 따른 갈등이기도 하다. 이러한 갈등은 첫째, 교육감의 이념적 성향에 따라 교육 정책이 변화하고 있고 둘째, 교육감과 교육부 장관의 사무가 분명하게 구분되지 않고 있으며, 마지막으로, 교육위원의 폐지 및 교육위원회와 광역의회의 통합으로 인해 교육감에 대한 견제가 미미하기 때문이다. 이에 본 연구는 교육위원회와 교육위원제의 부활 또는 교육감의 소속 정당부여를 대안으로 제시하였다.

영문 초록

This study analyzed the conflicts between the Ministry of Education (MOE) and the Seoul Metropolitan Office of Education (SMOE) on the “Independent Private High School” policy by the perspective of ‘Policy Paradox’. Although it seems like conflicts between MOE and SMOE on the surface, these conflicts can be regarded as natutral phenomena rather than problems to be solved. Under the popular vote system, the superintendents had no choice but to politicize the education issues in order to get the ballots but MOE had to supervise it for carrying the political neutrality in education. Concerning ‘Independent Private High School Policy’, there exist some conflicts between SMOE and other metropolitan and provincial Offices of Education. Reflecting the goal of policy like ‘equity’ vs. ‘excellence’, these phenomena also included conflicts between ‘independent private high schools and their parents’ and ‘SMOE . Moreover, These can also be seen as conflicts within the SMOE between those who pursued to change and maintain the continuing policy. By the ‘Policy Paradox’ perspective, there could be three alternative ways of reasoning the origins of these conflicts. First, education policy were depending on the superintendent s political ideology. Second, the lack of clear distinction between the tasks of the superintendent and the Minister of Education. Finally, the absence of the mechanism to keep check and balance on the education superintendent could be a alternative explanation. Paradoxically, this study suggested alternative solutions like reviving‘the independent board of education’and ‘council of education’and allowing party support of the superintendent.
