국문 초록

The 'Digital China' strategy, as an important engine for promoting Chinese-style modernisation in China's digital era, has given rise to digital jurisprudence as an emerging cross-discipline. In order to promote the further development of digital jurisprudence in China, this paper analyses the necessity and reasonableness of the development of digital jurisprudence in China, and finds that in order to promote the development of digital jurisprudence, it is necessary to adhere to the value guidance of the digital rule of law in Xi Jinping's thought on the rule of law, the principle of people-centered subjectivity, and the basic principle of the organic combination of autonomy and openness. On this basis, we attach importance to the basic theoretical research of digital jurisprudence, take into account the coordinated application of the legislative and judicial levels, and construct the teaching system of digital jurisprudence in the experimental curriculum, so as to provide a path choice for the development of digital jurisprudence in China.

영문 초록

“数字中国”战略作为中国数字时代推进中国式现代化的重要引擎，催生了数字法学这一新兴交叉学科。为了促进中国数字法学的进一步发展，本文分析了数字法学在中国发展的必要性和合理性，运用文献分析法、辩证分析法、跨学科分析法等方法，发现要促进数字法学的发展，需要坚持以习近平法治思想中数字法治观的价值指引、以人为本的主体性原则以及自主性与开放性有机结合的基本原则，并在此基础上重视数字法学的基础理论研究、兼顾立法与司法两层面的协调应用和构建数字法学在课程实验中的教学体系，为中国数字法学发展提供路径选择。
