국문 초록

본 연구의 목적은 선행연구에서 제시한 국경 간 전자상거래의 문제 및 최근 e-Commerce 플랫폼의 급성장으로 인한 다양한 문제점을 확인하고, 해당 문제점 개선을 위한 대응 방안을 제시하는 것이다. 본 연구는 e-Commerce 플랫폼 성장 추이를 살펴보고 중국의 e-Commerce 플랫폼의 공세가 국내소비자에게 미치는 직접적인 피해 현황을 분석함으로써 이러한 문제 해결을 위한 다양한 방안을 제시하였다는 점에서 선행연구와 차별성이 있다. 연구 결과에 따르면 중국 e-Commerce 플랫폼 성장으로 인한 문제점으로는 밀수입과 관세포탈 등 부정수입의 증가, 구매대행업체의 난립으로 인한 통관 질서의 문란, 소비자 개인정보 침해, 지식재산권침해가 있다. 그리고 문제점 해결을 위한 개선 방안으로는 관세포탈 등에 관한 벌칙 규정의 강화, 구매대행업체의 등록 요건 강화 및 납세의무자 규정의 개정 필요성, 개인정보 보호 제도 강화, 지식재산권 보호 방안, 기업 측면의 대응 방안 을 제시하였다.

영문 초록

Purpose: This study analyzes the growth trends of e-Commerce platforms and the direct damage caused to domestic consumers by China's e-Commerce platform offensive, and presents countermeasures to improve the problems. Research design, data, and methodology: This study analyzes related literature reviews. Results: Problems caused by the growth of e-Commerce platforms include increased illegal imports, increased consumer damage, increased smuggling and customs evasion, personal information protection issues, and infringement of intellectual property rights, which have increased to a serious level. The increase in illegal imports under the guise of overseas direct purchase and the increase in customs evasion through undervalue are causing serious damage to the national economy and are causing turbulence in the customs clearance order, adversely affecting the sound customs clearance culture. Conclusions: The government's active efforts are needed to further strengthen penalties under the Customs Act and establish a sound customs clearance order through continuous promotion and information provision. In addition, damage to consumers due to the proliferation of purchasing agents is increasing at a serious level, and improvements to the customs law system are needed to resolve these problems. Lastly, due to the increase in cross-border e-commerce, we must come up with a response plan to protect the personal information of Korean citizens collected by overseas e-commerce platforms and eradicate the import of harmful goods by strengthening the certification system
