국문 초록

ISBP 821은 2013년 이후 10년간 ICC 국가 위원회가 승인한 의견서에서 확인된 관행을 포함했다. 특히 용어(단복수), 사전 고려 사항에서 발행은행이 부여한 관리 조건의 효력, 송장의 작성 방법, 송장과 신용장 통화 단위, 선박 스탬프(ship's stamp)를 사용한 운송 서류 서명의 효력, 대리인이 발행한 보험서류의 서명 방법 등이 제도권으로 편입되었다. ISBP 821은 ICC 국가 위원회에서 합의한 관행을 반영한 화환신용장에 따른 문서 심사를 위한 최신 지침이며, 화환신용장 수익자가 지정은행 또는 발행은행에 문서를 작성하고 제출하는 반드시 알아야 하는 사항들이다. 따라서 신용장을 취급하는 은행을 포함한 금융기관, 무역거래자는 ISBP 821에 포함된 최신 신용장 업무 관행을 꼭 알아야 한다. 신용장은 거래를 방해하는 것이 아니라 거래를 촉진하기 위해 마련되었다. 은행은 국제무역 거래를 원활하게 하고 수익자와 매입은행·확인은행의 심사 권한을 존중하는 방향으로 UCP 600과 ISBP를 해석하여 신용장거래를 해야 한다.

영문 초록

Purpose: This paper introduces the ICC opinions related to the revision of ISBP 821 and the content of the ISBP revision to trade and finance practitioners who handle letters of credit. Hence, they can apply the latest ISBP when examining documents related to letters of credit and reviewing the presented documents. Research design, data, and methodology: This paper analyzed the ICC opinions and related cases and revised paragraphs of ISBP 821. Results: ISBP 821 is the latest guidance for reviewing documents under the letters of credit, reflecting the practices agreed upon by the ICC National Committee, and is a must-know for letter of credit beneficiaries to prepare and present documents to the nominated bank or issuing bank. Therefore, financial institutions, including banks, and traders that handle letters of credit, must be aware of the revised ISBP 821. Conclusions: ISBP 821 is a rule that must be observed when presenting and reviewing a letter of credit in accordance with UCP 600. If the parties to the letter of credit do not abide by ISBP 821, they will be judged accordingly by the ICC Banking Committee, and there is a high likelihood of losing in court.
